친환경농어업 육성 및 유기식품 등의 관리ㆍ지원에 관한 법률 시행령 제7조(권한의 위임 또는 위탁)
Enforcement Decree of the Act on the Promotion of Environment-Friendly Agriculture and Fisheries and the Management and Support of Organic Food, etc., Article 7 (Delegation or Entrustment of Authority)
① 농림축산식품부장관 및 해양수산부장관은 법 제58조제1항에 따라 다음 각 호의 권한을 식품의약품안전처장에게 위탁한다.
(1) Pursuant to Article 58 (1) of the Act, the Minister of Agriculture, Food and Rural Affairs and the Minister of Oceans and Fisheries entrust the following authority to the Minister of Food and Drug Safety:
1. 법 제23조의2제2항에 따른 수입 유기식품등(비식용유기가공품은 제외한다. 이하 이 항에서 같다)의 인증 및 표시 기준 적합성 조사
1. Investigation of the conformity of imported organic food, etc. (excluding non-food organic processed products; hereinafter the same applies in this paragraph) to certification and labeling standards under Article 23-2 (2) of the Act;
2. 법 제23조의2제4항에 따른 수입 유기식품등의 신고의 수리
2. Acceptance of reports on imported organic food, etc. under Article 23-2 (4) of the Act.
② 농림축산식품부장관은 법 제58조제1항에 따라 다음 각 호의 권한 중 농업, 축산업, 농산물 및 축산물에 관한 권한을 농촌진흥청장에게 위임한다. <개정 2021.11.2>
(2) Pursuant to Article 58 (1) of the Act, the Minister of Agriculture, Food and Rural Affairs delegates to the Administrator of the Rural Development Administration the authority relating to agriculture, livestock industry, agricultural products, and livestock products among the following authority:
1. 법 제11조제1항제1호부터 제5호까지 및 제6호에 따른 실태조사ㆍ평가 및 같은 조 제3항에 따른 보고
1. Fact-finding surveys and evaluations under Article 11 (1) 1 through 5 and 6 of the Act and reports under paragraph (3) of the same Article;
2. 법 제12조제1항에 따른 사업장에의 출입 및 조사 시료(試料)의 채취
2. Entry into workplaces and collection of samples for investigation under Article 12 (1) of the Act;
3. 법 제13조제1항 및 제2항에 따른 친환경농어업 기술과 자재 등의 연구ㆍ개발과 보급 및 교육ㆍ지도에 필요한 시책의 마련과 지원
3. Preparation and support of policies necessary for research, development, dissemination, education, and guidance of environment-friendly agriculture and fisheries technologies and materials, etc. under Article 13 (1) and (2) of the Act.
③ 농림축산식품부장관은 법 제58조제1항에 따라 다음 각 호의 권한 중 임업 및 임산물에 관한 권한을 산림청장에게 위임한다.
(3) Pursuant to Article 58 (1) of the Act, the Minister of Agriculture, Food and Rural Affairs delegates to the Commissioner of the Korea Forest Service the authority relating to forestry and forest products among the following authority:
1. 법 제11조제1항제1호부터 제5호까지 및 제6호에 따른 실태조사ㆍ평가 및 같은 조 제3항에 따른 보고
1. Fact-finding surveys and evaluations under Article 11 (1) 1 through 5 and 6 of the Act and reports under paragraph (3) of the same Article;
2. 법 제12조제1항에 따른 사업장에의 출입 및 조사 시료의 채취
2. Entry into workplaces and collection of samples for investigation under Article 12 (1) of the Act;
3. 법 제13조에 따른 친환경농어업 기술과 자재 등의 연구ㆍ개발과 보급 및 교육ㆍ지도에 필요한 시책의 마련과 지원
3. Preparation and support of policies necessary for research, development, dissemination, education, and guidance of environment-friendly agriculture and fisheries technologies and materials, etc. under Article 13 of the Act;
4. 법 제15조제2항에 따른 우수 사례의 발굴ㆍ홍보
4. Discovery and promotion of excellent cases under Article 15 (2) of the Act;
5. 법 제16조제1항에 따른 유기식품등, 무농약원료가공식품, 친환경농수산물 또는 유기농어업자재의 생산자, 생산자단체, 유통업자 및 수출업자에 대한 시설의 설치자금 등의 지원
5. Support, such as funds for installing facilities, for producers, producer organizations, distributors, and exporters of organic food, etc., pesticide-free raw-material processed food, environment-friendly agricultural and fishery products, or organic agricultural and fishery materials under Article 16 (1) of the Act;
6. 법 제55조제2항에 따른 우선구매의 요청
6. Requests for preferential purchase under Article 55 (2) of the Act.
④ 농림축산식품부장관은 법 제58조제1항에 따라 다음 각 호의 권한 중 농업ㆍ축산업ㆍ임업, 농산물ㆍ축산물ㆍ임산물(이하 "농림축산물"이라 한다) 및 농림축산물 가공품(제3조제2호에 해당하는 경우는 제외한다)에 관한 권한을 국립농산물품질관리원장에게 위임한다.
(4) Pursuant to Article 58 (1) of the Act, the Minister of Agriculture, Food and Rural Affairs delegates to the Commissioner of the National Agricultural Products Quality Management Service the authority relating to agriculture, livestock industry, forestry, agricultural, livestock, and forest products (hereinafter referred to as "agricultural, forestry, and livestock products"), and processed products of agricultural, forestry, and livestock products (excluding cases falling under Article 3, subparagraph 2) among the following authority:
1. 법 제14조제1항부터 제3항까지의 규정에 따른 교육ㆍ훈련, 교육훈련기관의 지정 및 지원
1. Education and training, and designation of and support for education and training institutions under Article 14 (1) through (3) of the Act;
2. 법 제14조의2제1항에 따른 교육훈련기관의 지정취소 또는 업무정지 처분
2. Revocation of designation or suspension of business of education and training institutions under Article 14-2 (1) of the Act;
3. 법 제19조제1항에 따른 유기식품등에 대한 인증
3. Certification of organic food, etc. under Article 19 (1) of the Act;
4. 법 제23조제2항(법 제36조제3항에서 준용하는 경우를 포함한다)에 따른 인증품의 생산방법과 사용자재 등에 관한 정보 표시의 권고
4. Recommendation of labeling of information on production methods and materials used for certified products, etc. under Article 23 (2) of the Act (including where applied mutatis mutandis by Article 36 (3) of the Act);
5. 법 제23조제3항에 따른 제한적인 유기표시의 허용
5. Permission for limited organic labeling under Article 23 (3) of the Act;
6. 법 제23조의2제2항에 따른 수입 유기식품등 중 비식용유기가공품의 인증 및 표시 기준 적합성 조사
6. Investigation of the conformity of non-food organic processed products among imported organic food, etc. to certification and labeling standards under Article 23-2 (2) of the Act;
7. 법 제23조의2제4항에 따른 수입 유기식품등 중 비식용유기가공품의 신고의 수리
7. Acceptance of reports on non-food organic processed products among imported organic food, etc. under Article 23-2 (4) of the Act;
8. 법 제24조제1항(법 제34조제4항에서 준용하는 경우를 포함한다)에 따른 인증의 취소, 인증표시의 제거ㆍ정지 또는 시정조치 명령
8. Revocation of certification, removal or suspension of certification marks, or orders for corrective measures under Article 24 (1) of the Act (including where applied mutatis mutandis by Article 34 (4) of the Act);
9. 법 제24조제2항(법 제34조제4항에서 준용하는 경우를 포함한다)에 따른 인증사업자에 대한 인증 취소의 통지 및 인증기관의 인증 취소 사실 보고의 수리
9. Notification to certified business operators of the revocation of certification and acceptance of reports by certification bodies on the fact of revocation of certification under Article 24 (2) of the Act (including where applied mutatis mutandis by Article 34 (4) of the Act);
10. 법 제24조의2에 따른 과징금의 부과ㆍ징수
10. Imposition and collection of penalty surcharges under Article 24-2 of the Act;
11. 법 제25조에 따른 동등성 인정(외국정부와의 동등성 인정 관련 협정 체결은 제외한다) 및 동등성 인정 사실의 인터넷 홈페이지 게시
11. Recognition of equivalence under Article 25 of the Act (excluding the conclusion of agreements on recognition of equivalence with foreign governments) and posting of the fact of recognition of equivalence on the Internet website;
12. 법 제26조제1항에 따른 인증기관의 지정
12. Designation of certification bodies under Article 26 (1) of the Act;
13. 법 제26조제2항부터 제5항(법 제35조제2항에서 준용하는 경우를 포함한다)까지의 규정에 따른 인증기관의 지정 신청 수리, 지정 갱신, 평가업무의 위임ㆍ위탁, 변경신고의 수리 및 변경승인
13. Acceptance of applications for designation of certification bodies, renewal of designation, delegation or entrustment of evaluation duties, acceptance of reports of changes, and approval of changes under Article 26 (2) through (5) of the Act (including where applied mutatis mutandis by Article 35 (2) of the Act);
14. 법 제26조의2제1항(법 제35조제2항에서 준용하는 경우를 포함한다)에 따른 인증심사원의 자격 부여
14. Granting of qualifications for certification auditors under Article 26-2 (1) of the Act (including where applied mutatis mutandis by Article 35 (2) of the Act);

54. 법 제57조제1항에 따른 교육훈련기관의 지정취소, 인증심사원의 자격 취소, 인증기관 또는 공시기관의 지정취소에 대한 청문
54. Hearings on the revocation of designation of education and training institutions, the revocation of qualifications of certification auditors, and the revocation of designation of certification bodies or public notification bodies under Article 57 (1) of the Act;
55. 법 제62조제5항에 따른 과태료의 부과ㆍ징수
55. Imposition and collection of administrative fines under Article 62 (5) of the Act.
⑤ 해양수산부장관은 법 제58조제1항에 따라 다음 각 호의 권한 중 수산업, 수산물 및 그 가공품(제3조제1호에 해당하는 경우는 제외한다)에 관한 권한을 국립수산물품질관리원장에게 위임한다. <개정 2021.11.2>
