Act on the Promotion of Environment-Friendly Agriculture and Fisheries and the Management and Support of Organic Food, etc., Article 57 (Hearings, etc.)

① 농림축산식품부장관 또는 해양수산부장관은 다음 각 호의 어느 하나에 해당하는 경우에는 청문을 하여야 한다. <개정 2019.8.27>

1. 제14조의2제1항에 따라 교육훈련기관의 지정을 취소하는 경우

2. 제26조의2제3항(제35조제2항에서 준용하는 경우를 포함한다)에 따라 인증심사원의 자격을 취소하는 경우

3. 제29조제1항(제35조제2항에서 준용하는 경우를 포함한다) 또는 제47조제1항에 따라 인증기관 또는 공시기관의 지정을 취소하는 경우

② 인증기관 또는 공시기관이 제24조제1항(제34조제4항에서 준용하는 경우를 포함한다) 또는 제43조제1항에 따라 인증이나 공시를 취소하려는 경우에는 해당 사업자에게 의견제출의 기회를 주어야 한다. 다만, 해당 사업자가 청문을 신청하는 경우에는 청문을 하여야 한다. <개정 2016.12.2, 2019.8.27>

③ 제2항에 따른 의견제출 및 청문에 관하여는 「행정절차법」 제22조제4항부터 제6항까지 및 같은 법 제2장제2절의 규정을 준용한다. 이 경우 "행정청"은 "인증기관" 또는 "공시기관"으로 본다. <개정 2016.12.2, 2019.8.27>
