Enforcement Decree of the Act on Report on Real Estate Transactions, etc., Article 11 (Special Cases concerning Land Transaction Contracts of the State, etc.)
① 법 제14조제1항에서 "대통령령으로 정하는 공공기관 또는 공공단체"란 다음 각 호의 기관 또는 단체를 말한다. <개정 2019.4.2, 2022.2.17>
(1) "Any other public institution or public organization prescribed by Presidential Decree" in Article 14 (1) of the Act means any of the following institutions or organizations:
1. 「한국농수산식품유통공사법」에 따른 한국농수산식품유통공사
1. The Korea Agro-Fisheries and Food Trade Corporation under the Korea Agro-Fisheries and Food Trade Corporation Act;
2. 「대한석탄공사법」에 따른 대한석탄공사
2. The Korea Coal Corporation under the Korea Coal Corporation Act;
3. 「한국토지주택공사법」에 따른 한국토지주택공사
3. The Korea Land and Housing Corporation under the Korea Land and Housing Corporation Act;
4. 「한국관광공사법」에 따른 한국관광공사
4. The Korea Tourism Organization under the Korea Tourism Organization Act;
5. 「한국농어촌공사 및 농지관리기금법」에 따른 한국농어촌공사
5. The Korea Rural Community Corporation under the Korea Rural Community Corporation and Farmland Management Fund Act;
6. 「한국도로공사법」에 따른 한국도로공사
6. The Korea Expressway Corporation under the Korea Expressway Corporation Act;
7. 「한국석유공사법」에 따른 한국석유공사
7. The Korea National Oil Corporation under the Korea National Oil Corporation Act;
8. 「한국수자원공사법」에 따른 한국수자원공사
8. The Korea Water Resources Corporation under the Korea Water Resources Corporation Act;

12. Agricultural cooperatives, livestock cooperatives, and the National Agricultural Cooperative Federation under the Agricultural Cooperatives Act;

13. Fisheries cooperatives and the National Federation of Fisheries Cooperatives under the Fisheries Cooperatives Act;
14. 「중소기업진흥에 관한 법률」에 따른 중소벤처기업진흥공단
14. The Korea SMEs and Startups Agency under the Small and Medium Enterprises Promotion Act;
15. 「한국은행법」에 따른 한국은행
15. The Bank of Korea under the Bank of Korea Act;
16. 「지방공기업법」에 따른 지방공사와 지방공단
16. Local government-invested public corporations and local government public corporations under the Local Public Enterprises Act;
17. 「공무원연금법」에 따른 공무원연금공단
17. The Government Employees Pension Service under the Government Employees Pension Act;
18. 「인천국제공항공사법」에 따른 인천국제공항공사
18. The Incheon International Airport Corporation under the Incheon International Airport Corporation Act;
19. 「국민연금법」에 따른 국민연금공단
19. The National Pension Service under the National Pension Act;
20. 「사립학교교직원 연금법」에 따른 사립학교교직원연금공단
20. The Korea Teachers' Pension under the Teachers' Pension Act;
21. 「한국자산관리공사 설립 등에 관한 법률」에 따른 한국자산관리공사(이하 "한국자산관리공사"라 한다)
21. The Korea Asset Management Corporation under the Act on the Establishment of Korea Asset Management Corporation, etc. (hereinafter referred to as the "Korea Asset Management Corporation");
22. 「항만공사법」에 따른 항만공사
22. Port authorities under the Port Authority Act.
② 「국유재산법」 제2조제10호에 따른 총괄청 또는 같은 조 제11호에 따른 중앙관서의 장등이 같은 법 제9조에 따른 국유재산종합계획에 따라 국유재산을 취득하거나 처분하는 경우로서 법 제12조에 따른 허가기준에 적합하게 취득하거나 처분한 후 허가관청에 그 내용을 통보한 때에는 법 제14조제1항에 따른 협의가 성립된 것으로 본다.
(2) Where the general managing authority under subparagraph 10 of Article 2 of the State Property Act, or the head of a central government agency, etc. under subparagraph 11 of the same Article, acquires or disposes of state property in accordance with the comprehensive state property plan under Article 9 of the same Act, does so in conformity with the standards for permission under Article 12 of the Act, and then notifies the permitting authority of the details, the consultation under Article 14 (1) of the Act shall be deemed reached.
③ 법 제14조제2항제3호에서 "대통령령으로 정하는 경우"란 다음 각 호의 어느 하나에 해당하는 경우를 말한다. <개정 2018.2.9, 2018.2.27, 2022.2.17>
(3) "Other cases prescribed by Presidential Decree" in subparagraph 3 of Article 14 (2) of the Act means any of the following cases:
1. 「공익사업을 위한 토지 등의 취득 및 보상에 관한 법률」에 따라 토지를 협의취득ㆍ사용하거나 환매하는 경우
1. Where land is acquired or used by agreement, or repurchased, under the Act on Acquisition of and Compensation for Land, etc. for Public Works Projects;
2. 「국유재산법」 제9조에 따른 국유재산종합계획에 따라 국유재산을 일반경쟁입찰로 처분하는 경우
2. Where state property is disposed of by general competitive bidding in accordance with the comprehensive state property plan under Article 9 of the State Property Act;
3. 「공유재산 및 물품 관리법」 제10조에 따른 공유재산의 관리계획에 따라 공유재산을 일반경쟁입찰로 처분하는 경우
3. Where public property is disposed of by general competitive bidding in accordance with the public property management plan under Article 10 of the Public Property and Commodity Management Act;
4. 「도시 및 주거환경정비법」 제74조에 따른 관리처분계획 또는 「빈집 및 소규모주택 정비에 관한 특례법」 제29조에 따른 사업시행계획에 따라 분양하거나 보류지 등을 매각하는 경우
4. Where units are sold, or reserved land, etc. is sold, in accordance with a management and disposal plan under Article 74 of the Act on the Improvement of Urban Areas and Residential Environments or a project implementation plan under Article 29 of the Act on Special Cases concerning Unoccupied House or Small-Scale Housing Improvement;
5. 「도시개발법」 제26조에 따른 조성토지등의 공급계획에 따라 토지를 공급하는 경우, 같은 법 제35조에 따라 환지 예정지로 지정된 종전 토지를 처분하는 경우, 같은 법 제40조에 따른 환지처분을 하는 경우 또는 같은 법 제44조에 따라 체비지 등을 매각하는 경우
5. Where land is supplied in accordance with a supply plan for developed land, etc. under Article 26 of the Urban Development Act, former land designated as a planned replotting site is disposed of under Article 35 of the same Act, a replotting disposition is made under Article 40 of the same Act, or land reserved for project costs, etc. is sold under Article 44 of the same Act;
6. 「주택법」 제15조에 따른 사업계획의 승인을 받아 조성한 대지를 공급하는 경우 또는 같은 법 제54조에 따라 주택(부대시설 및 복리시설을 포함하며, 주택과 주택 외의 시설을 동일 건축물로 건축하여 공급하는 경우에는 그 주택 외의 시설을 포함한다)을 공급하는 경우
6. Where a building site developed with approval of a project plan under Article 15 of the Housing Act is supplied, or housing (including ancillary facilities and welfare facilities and, where housing and non-housing facilities are built and supplied in the same building, including those non-housing facilities) is supplied under Article 54 of the same Act;
7. 「택지개발촉진법」 제18조에 따라 택지를 공급하는 경우
7. Where housing sites are supplied under Article 18 of the Housing Site Development Promotion Act;
8. 「산업입지 및 개발에 관한 법률」 제2조제9호에 따른 산업단지개발사업 또는 같은 조 제12호에 따른 준산업단지를 개발하기 위한 사업으로 조성된 토지를 같은 법 제16조에 따른 사업시행자(같은 법 제38조에 따라 사업시행자로부터 분양에 관한 업무를 위탁받은 산업단지관리공단을 포함한다)가 분양하는 경우
8. Where land developed through an industrial complex development project under subparagraph 9 of Article 2 of the Industrial Sites and Development Act, or a project to develop a quasi-industrial complex under subparagraph 12 of the same Article, is sold by the project implementer under Article 16 of the same Act (including an industrial complex management agency entrusted by the project implementer with sales work under Article 38 of the same Act);
9. 「농어촌정비법」 제25조 또는 제26조에 따른 환지계획에 따라 환지처분을 하는 경우 또는 같은 법 제43조에 따라 농지 등의 교환ㆍ분할ㆍ합병을 하는 경우
9. Where a replotting disposition is made in accordance with a replotting plan under Article 25 or 26 of the Rural Community Improvement Act, or farmland, etc. is exchanged, divided, or merged under Article 43 of the same Act;
10. 「농어촌정비법」에 따른 사업시행자가 농어촌정비사업을 시행하기 위하여 농지를 매입하는 경우
10. Where a project implementer under the Rural Community Improvement Act purchases farmland to carry out a rural community improvement project;
11. 「상법」 제3편제4장제10절ㆍ제11절, 「채무자 회생 및 파산에 관한 법률」의 절차에 따라 법원의 허가를 받아 권리를 이전하거나 설정하는 경우
11. Where rights are transferred or created with the permission of a court in accordance with the procedures under Sections 10 and 11 of Chapter IV of Part III of the Commercial Act or under the Debtor Rehabilitation and Bankruptcy Act;
12. 국세 및 지방세의 체납처분 또는 강제집행을 하는 경우
12. Where a disposition on default of national or local taxes or a compulsory execution is carried out;
13. 국가 또는 지방자치단체가 법령에 따라 비상재해시 필요한 응급조치를 위하여 권리를 이전하거나 설정하는 경우
13. Where the State or a local government transfers or creates rights for emergency measures needed in a disaster under statutes;
14. 「한국농어촌공사 및 농지관리기금법」에 따라 한국농어촌공사가 농지의 매매ㆍ교환 및 분할을 하는 경우
14. Where the Korea Rural Community Corporation sells, exchanges, or divides farmland under the Korea Rural Community Corporation and Farmland Management Fund Act;
15. 법 제9조에 따라 외국인등이 토지취득의 허가를 받은 경우
15. Where a foreigner, etc. has obtained permission to acquire land under Article 9 of the Act;
16. 한국자산관리공사가 「한국자산관리공사 설립 등에 관한 법률」 제4조 또는 제5조에 따라 토지를 취득하거나 경쟁입찰을 거쳐서 매각하는 경우 또는 한국자산관리공사에 매각이 의뢰되어 3회 이상 공매하였으나 유찰된 토지를 매각하는 경우
16. Where the Korea Asset Management Corporation acquires land under Article 4 or 5 of the Act on the Establishment of Korea Asset Management Corporation, etc. or sells land through competitive bidding, or sells land that was entrusted to it for sale and remained unsold after three or more public sales;
17. 「국토의 계획 및 이용에 관한 법률」 제47조 또는 「개발제한구역의 지정 및 관리에 관한 특별조치법」 제17조에 따라 매수청구된 토지를 취득하는 경우
17. Where land for which a purchase request was made under Article 47 of the National Land Planning and Utilization Act or Article 17 of the Act on Special Measures for Designation and Management of Development Restriction Zones is acquired;
18. 「신행정수도 후속대책을 위한 연기ㆍ공주지역 행정중심복합도시 건설을 위한 특별법」, 「혁신도시 조성 및 발전에 관한 특별법」 또는 「기업도시개발 특별법」에 따라 조성된 택지 또는 주택을 공급하는 경우
18. Where housing sites or housing developed under the Special Act on the Construction of the Multifunctional Administrative City in Yeongi-Gongju Area for the Follow-Up Measures for the New Administrative Capital, the Special Act on the Development and Support of Innovation Cities, or the Special Act on Enterprise City Development are supplied;
19. 「건축물의 분양에 관한 법률」에 따라 건축물을 분양하는 경우
19. Where buildings are sold in lots under the Building Sales Act;
20. 「산업집적활성화 및 공장설립에 관한 법률」 제28조의4에 따라 지식산업센터를 분양하는 경우
20. Where a knowledge industry center is sold in lots under Article 28-4 of the Industrial Cluster Development and Factory Establishment Act;
21. 법령에 따라 조세ㆍ부담금 등을 토지로 물납하는 경우
21. Where taxes, charges, etc. are paid in kind with land under statutes.
