지방자치단체를 당사자로 하는 계약에 관한 법률 시행령 제37조(입찰보증금)

Enforcement Decree of the Act on Contracts to Which a Local Government Is a Party, Article 37 (Bid Bonds)

① 법 제12조에 따른 입찰보증금은 입찰금액(단가에 대하여 실시하는 입찰인 경우에는 그 단가에 매회별 이행예정량 중 최대량을 곱한 금액. 이하 이 항에서 같다)의 100분의 5 이상으로 하여야 한다. 다만, 「재난 및 안전관리 기본법」 제3조제1호에 따른 재난이나 경기침체, 대량실업 등으로 인한 국가 또는 해당 지역의 경제위기를 극복하기 위해 행정안전부장관이 기간을 정하여 고시한 경우에는 입찰보증금을 입찰금액의 1천분의 25 이상으로 할 수 있다. <개정 2015.8.19, 2020.7.14>
