가덕도신공항 건설을 위한 특별법 제11조(인ㆍ허가등의 의제)
Special Act on Construction of the Gadeokdo New Airport, Article 11 (Deemed authorizations, permissions, etc.)
① 국토교통부장관이 제10조제1항 및 제3항에 따라 실시계획을 수립하거나 승인하였을 때에는 다음 각 호의 승인ㆍ허가ㆍ인가ㆍ결정ㆍ지정ㆍ면허ㆍ협의ㆍ동의ㆍ심의 또는 해제 등(이하 "인ㆍ허가등"이라 한다)에 관하여 인ㆍ허가등의 관계 행정기관의 장과 미리 협의한 사항에 대해서는 해당 인ㆍ허가등을 받은 것으로 보고, 국토교통부장관이 제10조제6항에 따라 실시계획의 고시 또는 실시계획의 승인을 고시하였을 때에는 다음 각 호의 법률에 따른 인ㆍ허가등의 고시 또는 공고가 있는 것으로 본다. <개정 2021.11.30, 2022.12.27, 2024.1.9>
(1) Where the Minister of Land, Infrastructure and Transport has established or approved an implementation plan under Article 10 (1) and (3), with respect to matters on which the Minister has consulted in advance with the heads of the relevant administrative agencies for the following approvals, permissions, authorizations, decisions, designations, licenses, consultations, consents, deliberations or releases, etc. (hereinafter referred to as "authorizations, permissions, etc."), the relevant authorizations, permissions, etc. are deemed obtained, and when the Minister has publicly notified the implementation plan or approval of the implementation plan under Article 10 (6), the public notice or announcement of the authorizations, permissions, etc. under the following Acts is deemed made:
1. 「건설기술 진흥법」 제5조에 따른 건설기술심의위원회의 심의
1. Deliberation by the Construction Technology Deliberation Committee under Article 5 of the Construction Technology Promotion Act;
2. 「건축법」 제4조에 따른 건축위원회의 심의, 같은 법 제11조에 따른 건축허가, 같은 법 제14조에 따른 건축신고, 같은 법 제19조에 따른 용도변경 허가 및 신고, 같은 법 제20조제1항에 따른 가설건축물의 건축허가 및 같은 조 제3항에 따른 신고, 같은 법 제29조에 따른 건축허가권자와의 협의
2. Deliberation by the building committee under Article 4 of the Building Act, building permit under Article 11 of that Act, building report under Article 14 of that Act, permission for and reporting of change of use under Article 19 of that Act, building permit for a temporary building under Article 20 (1) of that Act and reporting under paragraph (3) of that Article, and consultation with the building permit authority under Article 29 of that Act;
3. 「경제자유구역의 지정 및 운영에 관한 특별법」 제9조에 따른 실시계획의 승인
3. Approval of an implementation plan under Article 9 of the Act on the Designation and Operation of Free Economic Zones;
4. Permission for aggregate extraction under Article 22 of the Aggregate Extraction Act;
5. 「공유수면 관리 및 매립에 관한 법률」 제8조에 따른 공유수면의 점용ㆍ사용허가 및 점용ㆍ사용허가의 고시, 같은 법 제17조에 따른 공유수면 점용ㆍ사용 실시계획의 승인 또는 신고, 같은 법 제28조에 따른 공유수면의 매립면허, 같은 법 제33조에 따른 매립면허의 고시, 같은 법 제35조에 따른 매립면허관청과의 협의 또는 매립면허관청의 승인 및 같은 법 제38조에 따른 공유수면매립실시계획의 승인
5. Permission for occupancy and use of public waters and public notice of permission for occupancy and use under Article 8 of the Public Waters Management and Reclamation Act, approval of or reporting on an implementation plan for occupancy and use of public waters under Article 17 of that Act, a reclamation license for public waters under Article 28 of that Act, public notice of a reclamation license under Article 33 of that Act, consultation with, or approval of, the reclamation licensing authority under Article 35 of that Act, and approval of a public waters reclamation implementation plan under Article 38 of that Act;
6. 「국토의 계획 및 이용에 관한 법률」 제30조에 따른 도시ㆍ군관리계획의 결정, 같은 법 제56조에 따른 개발행위의 허가, 같은 법 제86조에 따른 도시ㆍ군계획시설사업 시행자의 지정, 같은 법 제88조에 따른 실시계획의 인가 및 같은 법 제91조에 따른 실시계획의 고시
6. Decision on an urban/Gun management plan under Article 30 of the National Land Planning and Utilization Act, permission for development activities under Article 56 of that Act, designation of the implementer of an urban/Gun planning facility project under Article 86 of that Act, authorization of an implementation plan under Article 88 of that Act, and public notice of an implementation plan under Article 91 of that Act;
7. 「군사기지 및 군사시설 보호법」 제13조에 따른 행정기관의 허가 등에 관한 협의
7. Consultation on permissions, etc. of administrative agencies under Article 13 of the Protection of Military Bases and Installations Act;
8. 「농지법」 제34조에 따른 농지전용의 허가 또는 협의
8. Permission for or consultation on conversion of farmland under Article 34 of the Farmland Act;
9. 「대기환경보전법」 제23조, 「물환경보전법」 제33조 및 「소음ㆍ진동관리법」 제8조에 따른 배출시설 설치의 허가 또는 신고
9. Permission for or reporting of installation of discharge facilities under Article 23 of the Clean Air Conservation Act, Article 33 of the Water Environment Conservation Act and Article 8 of the Noise and Vibration Control Act;
10. 「도로법」 제107조에 따른 도로관리청과의 협의 또는 승인(같은 법 제19조에 따른 도로 노선의 지정ㆍ고시, 같은 법 제25조에 따른 도로구역의 결정, 같은 법 제36조에 따른 도로관리청이 아닌 자에 대한 도로공사의 시행허가, 같은 법 제61조제1항에 따른 도로의 점용 허가에 관한 것만 해당한다)
10. Consultation with or approval of the road management authority under Article 107 of the Road Act (limited to designation and public notice of road routes under Article 19 of that Act, decision on road zones under Article 25 of that Act, permission for implementation of road works by a person other than a road management authority under Article 36 of that Act, and permission for road occupancy under Article 61 (1) of that Act);
11. 「도시공원 및 녹지 등에 관한 법률」 제24조에 따른 도시공원의 점용허가
11. Permission for occupancy of an urban park under Article 24 of the Act on Urban Parks and Green Areas, etc.;
12. 「도시교통정비 촉진법」 제16조에 따른 교통영향평가서의 제출 및 검토
12. Submission and review of a traffic impact assessment report under Article 16 of the Urban Transportation Improvement Promotion Act;
13. 「도시철도법」 제7조제1항에 따른 도시철도사업계획의 승인 및 같은 법 제26조제1항에 따른 도시철도운송사업의 면허
13. Approval of an urban railway business plan under Article 7 (1) of the Urban Railway Act and a license for urban railway transportation business under Article 26 (1) of that Act;
14. 「사방사업법」 제14조에 따른 사방지(砂防地)에서의 벌채 등의 허가 및 같은 법 제20조에 따른 사방지 지정의 해제
14. Permission for felling, etc. in erosion control areas under Article 14 of the Erosion Control Work Act and de-designation of erosion control areas under Article 20 of that Act;
15. 「산림보호법」 제11조에 따른 산림보호구역의 지정해제
15. De-designation of forest protection zones under Article 11 of the Forest Protection Act;
16. 「산림자원의 조성 및 관리에 관한 법률」 제36조제1항ㆍ제5항에 따른 입목의 벌채 등의 허가ㆍ신고
16. Permission for and reporting of felling of standing trees, etc. under Article 36 (1) and (5) of the Act on the Creation and Management of Forest Resources;
17. 「산업입지 및 개발에 관한 법률」 제16조에 따른 산업단지개발사업의 시행자 지정 및 같은 법 제17조에 따른 국가산업단지개발실시계획의 승인
17. Designation of the implementer of an industrial complex development project under Article 16 of the Industrial Sites and Development Act and approval of a national industrial complex development implementation plan under Article 17 of that Act;
18. 「산업집적활성화 및 공장설립에 관한 법률」 제13조에 따른 공장설립 등의 승인 및 신고
18. Approval of and reporting on factory establishment, etc. under Article 13 of the Industrial Cluster Development and Factory Establishment Act;

20. 「소방시설공사업법」 제13조제1항에 따른 소방시설공사의 신고
20. Reporting of fire protection system construction under Article 13 (1) of the Fire Protection Systems Construction Business Act;

22. Permission for installation of manufacturing facilities, etc. under Article 6 (1) of the Hazardous Materials Safety Management Act;
23. 「자연공원법」 제71조제1항에 따른 공원관리청과의 협의(같은 법 제23조에 따른 공원구역에서의 행위허가에 관한 것만 해당한다)
23. Consultation with the park management authority under Article 71 (1) of the Natural Parks Act (limited to permission for acts in park zones under Article 23 of that Act);
24. 「장사 등에 관한 법률」 제27조제1항에 따른 무연분묘의 개장허가
24. Permission for exhumation of unclaimed graves under Article 27 (1) of the Act on Funeral Services, etc.;
25. 「초지법」 제23조에 따른 초지전용(草地轉用)의 허가ㆍ신고 또는 협의
25. Permission for, reporting of, or consultation on conversion of grassland under Article 23 of the Grassland Act;
26. 「폐기물관리법」 제29조제2항에 따른 폐기물처리시설 설치의 승인 또는 신고
26. Approval of or reporting on installation of waste treatment facilities under Article 29 (2) of the Wastes Control Act;
27. 「하수도법」 제16조에 따른 공공하수도 공사ㆍ유지의 허가, 같은 법 제24조에 따른 점용행위에 관한 허가 및 같은 법 제34조제2항에 따른 개인하수처리시설의 설치 등에 대한 신고
27. Permission for construction or maintenance of public sewerage under Article 16 of the Sewerage Act, permission for occupancy acts under Article 24 of that Act, and reporting of installation, etc. of individual sewage treatment facilities under Article 34 (2) of that Act;
28. 「하천법」 제6조에 따른 하천관리청과의 협의 또는 승인(같은 법 제30조에 따른 하천공사 시행의 허가, 같은 법 제33조에 따른 하천의 점용허가 및 점용허가의 고시, 같은 법 제50조에 따른 하천수의 사용허가에 관한 것만 해당한다)
28. Consultation with or approval of the river management authority under Article 6 of the River Act (limited to permission for implementation of river works under Article 30 of that Act, permission for river occupancy and public notice of permission for occupancy under Article 33 of that Act, and permission for use of river water under Article 50 of that Act);
29. 「항로표지법」 제9조제6항, 제13조 또는 제14조에 따른 항로표지의 설치ㆍ관리의 허가 또는 신고
29. Permission for or reporting of installation and management of aids to navigation under Article 9 (6), 13 or 14 of the Aids to Navigation Act;
30. 「항만법」 제9조제2항에 따른 항만개발사업 시행의 허가 및 같은 법 제10조제2항에 따른 항만개발사업실시계획의 승인
30. Permission for implementation of port development projects under Article 9 (2) of the Harbor Act and approval of a port development project implementation plan under Article 10 (2) of that Act;
31. 「소방시설 설치 및 관리에 관한 법률」 제6조제1항에 따른 건축허가등의 동의
31. Consent to building permits, etc. under Article 6 (1) of the Fire Protection Systems Installation and Management Act.
② 국토교통부장관은 제10조제1항 또는 제3항에 따라 실시계획을 수립 또는 승인을 하려는 경우에는 그 실시계획에 제1항 각 호의 어느 하나에 해당하는 사항이 포함되어 있으면 그 실시계획이 제1항 각 호에 따른 법률에 적합한지에 관하여 미리 관계 행정기관의 장과 협의하여야 한다.
(2) Where the Minister of Land, Infrastructure and Transport intends to establish or approve an implementation plan under Article 10 (1) or (3), if the implementation plan includes matters falling under any subparagraph of paragraph (1), the Minister shall consult in advance with the heads of relevant administrative agencies on whether the implementation plan conforms to the Acts under each subparagraph of paragraph (1).
③ 제1항 및 제2항에서 규정한 사항 외에 인ㆍ허가등 의제의 기준 및 효과 등에 관하여는 「행정기본법」 제24조부터 제26조까지를 준용한다. <개정 2024.1.9>
(3) In addition to matters prescribed in paragraphs (1) and (2), Articles 24 through 26 of the Framework Act on Administration apply mutatis mutandis to the criteria and effect, etc. of deemed authorizations, permissions, etc.
