Enforcement Decree of the Road Act, Article 100 (Delegation of Authority)
① 국토교통부장관은 법 제110조제1항에 따라 대도시권 교통혼잡도로에 관한 다음 각 호의 권한을 「대도시권 광역교통 관리에 관한 특별법」 제8조에 따른 대도시권광역교통위원회에 위임한다. <신설 2019.3.19>
(1) Under Article 110 (1) of the Act, the Minister of Land, Infrastructure and Transport delegates the following authority concerning congested roads in metropolitan areas to the Metropolitan Transport Commission under Article 8 of the Special Act on the Management of Wide-Area Transportation in Metropolitan Areas:
1. 법 제8조제1항에 따른 대도시권 교통혼잡도로 개선사업계획의 수립, 같은 조 제6항 본문에 따른 대도시권 교통혼잡도로 개선사업계획의 변경 및 같은 조 제7항에 따른 교통혼잡 실태 등의 조사
1. Formulation of improvement project plans for congested roads in metropolitan areas under Article 8 (1) of the Act, changes to improvement project plans for congested roads in metropolitan areas under the main clause of paragraph (6) of the same Article, and surveys of the actual state of traffic congestion and the like under paragraph (7) of the same Article;
2. 제87조제1항에 따른 공사착공보고 및 분기별 공정보고의 접수, 같은 조 제2항에 따른 사업실적보고의 접수
2. Receipt of reports on commencement of construction and quarterly progress reports under Article 87 (1), and receipt of project performance reports under Article 87 (2).
② 국토교통부장관은 법 제110조제1항에 따라 일반국도에 관한 권한을 다음 각 호의 구분에 따라 시ㆍ도지사에게 위임한다. <개정 2019.3.19>
(2) Under Article 110 (1) of the Act, the Minister of Land, Infrastructure and Transport delegates authority concerning general national roads to Mayors/Do Governors, according to the following classification:
1. 일반국도(제2호에 따른 위임국도는 제외한다)에 대해서는 다음 각 목의 권한
1. For general national roads (excluding delegated national roads under subparagraph 2), the following authority:
가. 법 제40조제2항에 따른 접도구역의 관리에 관한 사항
(a) Matters concerning management of roadside zones under Article 40 (2) of the Act;
나. 법 제40조제3항을 위반한 자에 대한 법 제96조에 따른 처분 또는 조치
(b) Dispositions or measures under Article 96 of the Act against persons who violate Article 40 (3) of the Act;
2. 위임국도에 대해서는 제1호 각 목 및 제3항 각 호(제3호는 제외한다)에 따른 권한
2. For delegated national roads, the authority under the items of subparagraph 1 and the subparagraphs of paragraph (3) (excluding subparagraph 3).
③ 국토교통부장관은 법 제110조제1항에 따라 제2항제2호의 구간을 제외한 일반국도에 관한 다음 각 호의 권한을 지방국토관리청장에게 위임한다. <개정 2018.9.11, 2019.3.19, 2025.2.7, 2025.7.29>
(3) Under Article 110 (1) of the Act, the Minister of Land, Infrastructure and Transport delegates the following authority concerning general national roads, excluding the sections under paragraph (2) 2, to the head of a regional office of land management:
1. 법 제25조에 따른 도로구역의 결정ㆍ변경ㆍ폐지 및 고시
1. Determination, change, abolition, and public notice of road zones under Article 25 of the Act;
2. 법 제30조제1항 및 제2항에 따른 도로구역 내 시설의 설치ㆍ운영 및 사전 협의
2. Installation and operation of facilities within road zones and prior consultation under Article 30 (1) and (2) of the Act;
3. 법 제31조제1항에 따른 도로공사와 도로의 유지ㆍ관리
3. Road works and road maintenance and management under Article 31 (1) of the Act;
4. 법 제32조제1항 및 제3항에 따른 도로공사 및 권한의 대행에 관한 사항
4. Matters concerning performance of road works and authority on behalf of another under Article 32 (1) and (3) of the Act;
5. 법 제33조제1항 및 제3항에 따른 타공작물의 관리자에 대한 도로공사의 시행명령, 도로의 유지ㆍ관리 명령 및 준공검사
5. Orders to managers of other structures to carry out road works, orders for road maintenance and management, and completion inspections under Article 33 (1) and (3) of the Act;
6. 법 제33조제1항 및 제4항에 따른 타공작물에 관한 공사의 직접 시행과 공사시행 및 준공 사실의 통지
6. Direct performance of works on other structures and notice of commencement and completion of works under Article 33 (1) and (4) of the Act;
7. 법 제34조에 따른 부대공사의 시행

20. 법 제57조에 따른 도로관리원의 임명

35. 법 제90조에 따른 부대공사 비용의 부과ㆍ징수
35. Imposition and collection of costs of ancillary works under Article 90 of the Act;
36. 법 제91조제1항ㆍ제3항 및 제4항에 따른 원인자 및 공공단체 또는 사인 등에 대한 비용의 부과ㆍ징수, 같은 조 제5항 및 제6항에 따른 정보의 제공 요청 및 관리ㆍ파기
36. Imposition and collection of costs from persons causing costs and from public bodies or private persons under Article 91 (1), (3), and (4) of the Act, and requests for provision of information and management and destruction of information under paragraphs (5) and (6) of the same Article;
37. 법 제96조에 따른 법령 위반자 등에 대한 처분 또는 조치(제1항제1호나목에 따라 시ㆍ도지사에게 위임되는 권한은 제외한다)
37. Dispositions or measures against violators of statutes, etc. under Article 96 of the Act (excluding authority delegated to Mayors/Do Governors under paragraph (1) 1 (b));
38. 법 제97조에 따른 공익을 위한 처분
38. Dispositions for the public interest under Article 97 of the Act;

④ 국토교통부장관은 법 제110조제1항에 따라 국가지원지방도에 관한 다음 각 호의 권한을 지방국토관리청장에게 위임한다. <개정 2019.3.19>
(4) Under Article 110 (1) of the Act, the Minister of Land, Infrastructure and Transport delegates the following authority concerning national support local roads to the head of a regional office of land management:
1. 제87조제1항에 따른 공사착공보고 및 분기별 공정보고의 접수
1. Receipt of reports on commencement of construction and quarterly progress reports under Article 87 (1);
2. 제87조제2항에 따른 사업실적보고의 접수
2. Receipt of project performance reports under Article 87 (2).
⑤ 지방국토관리청장은 제4항 각 호에 따른 공사착공보고 및 분기별 공정보고와 사업실적보고를 받은 경우에는 국토교통부령으로 정하는 바에 따라 국토교통부장관에게 보고하여야 한다. <개정 2019.3.19>
(5) When the head of a regional office of land management has received a report on commencement of construction, a quarterly progress report, or a project performance report under the subparagraphs of paragraph (4), he or she shall report it to the Minister of Land, Infrastructure and Transport, as prescribed by Ordinance of the Ministry of Land, Infrastructure and Transport.
⑥ 국토교통부장관은 법 제110조제1항에 따라 고속국도에 관한 법 제117조에 따른 과태료의 부과ㆍ징수 권한을 지방국토관리청장에게 위임한다. <개정 2019.3.19>
(6) Under Article 110 (1) of the Act, the Minister of Land, Infrastructure and Transport delegates the authority to impose and collect administrative fines under Article 117 of the Act concerning national expressways to the head of a regional office of land management.
