도로법 제33조(타공작물의 공사시행)

① 도로관리청은 도로가 타공작물의 효용을 함께 갖추고 있거나 타공작물이 도로의 효용을 함께 갖추고 있는 경우 대통령령으로 정하는 바에 따라 타공작물의 관리자에게 도로공사를 시행하게 하거나 도로의 유지ㆍ관리를 하게 할 수 있으며, 도로관리청이 직접 타공작물에 관한 공사를 시행하거나 타공작물에 대한 유지ㆍ관리를 할 수 있다.

② 도로관리청이 제1항에 따라 타공작물에 관한 공사를 시행하거나 타공작물에 대한 관리를 할 경우 이를 도로공사 또는 도로의 유지ㆍ관리로 본다.

③ 도로관리청이 제1항에 따라 타공작물의 관리자에게 도로공사를 시행하게 하는 경우 해당 타공작물의 관리자는 도로공사를 마친 후 대통령령으로 정하는 바에 따라 도로관리청의 준공검사를 받아야 한다.

④ 도로관리청이 제1항에 따라 직접 타공작물에 관한 공사(타공작물의 관리는 제외한다. 이하 이 조에서 같다)를 시행하는 경우에는 타공작물의 관리자에게 대통령령으로 정하는 바에 따라 공사를 시행하기 전에 미리 통지하여야 하며, 공사를 준공하였을 때에는 해당 공사의 준공 사실을 통지하여야 한다. 다만, 타공작물의 관리자가 중앙 행정기관의 장, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장인 경우에는 미리 협의하여야 한다.
