Enforcement Decree of the Act on the Protection and Management of Wildlife, Article 39 (Delegation of Authority)
① 기후에너지환경부장관은 법 제66조제1항에 따라 법 제31조에 따른 특별보호구역의 토지 등의 매수 및 손실보상에 관한 권한을 시ㆍ도지사에게 위임한다. <개정 2025.10.1>
(1) Pursuant to Article 66 (1) of the Act, the Minister of Climate, Energy and Environment delegates to the Mayor/Do Governor the authority relating to the purchase of land, etc. in Special Protection Areas and compensation for losses under Article 31 of the Act.
② 기후에너지환경부장관은 법 제66조제1항에 따라 다음 각 호의 권한을 유역환경청장 또는 지방환경청장에게 위임한다. <개정 2014.7.16, 2020.5.26, 2023.3.14, 2024.5.14, 2025.10.1>
(2) Pursuant to Article 66 (1) of the Act, the Minister of Climate, Energy and Environment delegates the following authority to the head of a Basin Environmental Office or the head of a Regional Environmental Office:
1. 법 제9조제2항에 따른 야생동물 등에 대한 압류 등 필요한 조치
1. Necessary measures such as seizure of wild animals, etc. under Article 9 (2) of the Act;
2. 법 제14조제1항 단서에 따른 멸종위기 야생생물의 포획ㆍ채취등의 허가
2. Permits for capturing or collecting, etc. endangered wildlife under the proviso of Article 14 (1) of the Act;
3. 법 제14조제2항 단서에 따른 폭발물 사용 등의 허가
3. Permits for using explosives, etc. under the proviso of Article 14 (2) of the Act;
4. 법 제14조제4항에 따른 포획ㆍ채취등 신고의 접수
4. Receipt of reports of capture or collection, etc. under Article 14 (4) of the Act;
5. 법 제14조제5항에 따른 보관 신고의 접수

15. Guidance and enforcement of, and restrictions on acts of, persons who commit acts of damage or prohibited acts in Special Protection Areas under Article 28 of the Act;
16. 법 제29조에 따른 특별보호구역에서의 출입의 제한ㆍ금지, 출입 제한ㆍ금지 지역의 위치 등의 고시, 출입 제한ㆍ금지의 해제 및 그 사실의 고시
16. Restriction or prohibition of entry into Special Protection Areas under Article 29 of the Act, announcement of the locations of areas of restricted or prohibited entry, etc., and lifting of restrictions or prohibitions on entry and announcement thereof;
17. 법 제30조에 따른 특별보호구역에서의 행위중지, 원상회복 및 이에 상응하는 조치의 명령

(3) Pursuant to Article 66 (1) of the Act, the Minister of Climate, Energy and Environment delegates the following authority to the Director of the National Wildlife Disease Control Institute:
1. 법 제34조의8제1항에 따른 야생동물 질병의 발생 현황 공개
1. Disclosure of the occurrence status of wild animal diseases under Article 34-8 (1) of the Act;
2. 법 제34조의15제1항 단서에 따른 수입 허가
2. Import permits under the proviso of Article 34-15 (1) of the Act;
3. 법 제57조제8호의2에 따른 포상금 지급
3. Payment of rewards under Article 57 subparagraph 8-2 of the Act;
4. 법 제73조제2항제6호의2에 따른 과태료의 부과ㆍ징수
4. Imposition and collection of administrative fines under Article 73 (2) 6-2 of the Act.
④ 기후에너지환경부장관은 법 제66조제1항에 따라 법 제6조의3제1항에 따른 야생동물종합관리시스템의 구축 및 운영에 관한 권한을 국립생물자원관장에게 위임한다. <신설 2023.12.12, 2025.10.1>
(4) Pursuant to Article 66 (1) of the Act, the Minister of Climate, Energy and Environment delegates to the Director of the National Institute of Biological Resources the authority relating to the establishment and operation of the comprehensive wild animal management system under Article 6-3 (1) of the Act.
