Enforcement Decree of the Mining Industry Act, Article 71 (Delegation of Authority)
①법 제96조에 따라 산업통상부장관의 권한 중 다음 각 호의 권한은 특별시장ㆍ광역시장ㆍ도지사 또는 특별자치도지사에게 위임한다. <개정 2008.2.29, 2010.12.28, 2013.3.23, 2025.10.1>
(1) Pursuant to Article 96 of the Act, the following authority of the Minister of Industry and Trade is delegated to the Special Metropolitan City Mayor, Metropolitan City Mayor, Do Governor, or Special Self-Governing Province Governor:
1. 법 제42조제1항ㆍ제3항 및 제5항(법 제61조에서 준용하는 경우를 포함한다)에 따른 채굴계획 인가, 변경인가, 채굴계획 인가의 신청 기간 연장 및 채굴계획의 변경명령
1. Approval and approval of change of mining plans, extension of the application period for approval of mining plans, and orders to change mining plans under Article 42 (1), (3), and (5) of the Act (including cases applied mutatis mutandis under Article 61 of the Act)
2. 법 제42조의2(법 제61조에서 준용하는 경우를 포함한다)에 따른 채굴의 중단인가 및 채굴재개신고 수리
2. Approval of suspension of mining and acceptance of reports of resumption of mining under Article 42-2 of the Act (including cases applied mutatis mutandis under Article 61 of the Act)
3. 법 제45조(법 제61조에서 준용하는 경우를 포함한다)에 따른 지도ㆍ점검 및 시정명령
3. Guidance, inspection, and corrective orders under Article 45 of the Act (including cases applied mutatis mutandis under Article 61 of the Act)
4. 법 제49조제2항에 따른 조광권의 존속기간 연장인가

②법 제96조에 따라 산업통상부장관의 권한 중 다음 각 호의 권한은 광업등록사무소장에게 위임한다. <개정 2008.2.29, 2010.12.28, 2012.8.24, 2013.3.23, 2025.10.1>
(2) Pursuant to Article 96 of the Act, the following authority of the Minister of Industry and Trade is delegated to the head of a mining registration office:
1. 법 제12조제3항에 따른 채굴권 존속기간 연장허가
1. Permission to extend the duration of mining rights under Article 12 (3) of the Act
2. 법 제14조제1항ㆍ제2항 및 제4항에 따른 단위구역의 예외 광구의 설정 및 측점의 설치
2. Establishment of exceptional mining claims for unit zones and installation of survey points under Article 14 (1), (2), and (4) of the Act
3. 제8조에 따른 합의서의 접수
3. Receipt of written agreements under Article 8
4. 법 제15조에 따른 광업권의 설정허가, 광업권설정출원서 등의 접수, 출원서류 등의 수정 또는 보완명령, 현장조사 및 광업출원인 등의 출석명령
4. Permission for establishment of mining rights under Article 15 of the Act, receipt of applications for establishment of mining rights, orders to correct or supplement application documents, field investigations, and orders for attendance of mining applicants, etc.
5. 제10조에 따른 광업권 설정출원의 불수리 및 각하
5. Non-acceptance and dismissal of applications for establishment of mining rights under Article 10
6. 법 제17조(법 제30조에서 준용하는 경우를 포함한다)에 따른 대표자 신고 및 대표자 변경신고의 수리, 대표자의 지정
6. Acceptance of reports of representatives and reports of change of representatives, and designation of representatives, under Article 17 of the Act (including cases applied mutatis mutandis under Article 30 of the Act)
7. 제17조에 따른 광업권설정 출원 취하 등의 접수
