농어촌마을 주거환경 개선 및 리모델링 촉진을 위한 특별법 제17조(다른 법률의 인ㆍ허가등의 의제)

Special Act on Improvement of the Residential Environment and Promotion of Remodeling of Rural and Fishing Villages, Article 17 (Deemed Authorizations and Permits under Other Statutes)

① 사업시행자가 제16조에 따라 실시계획 승인을 받은 때(시장ㆍ군수ㆍ구청장이 직접 정비사업을 시행하는 경우에는 실시계획을 작성한 때를 말한다)에는 다음 각 호의 인가ㆍ허가ㆍ승인ㆍ신고ㆍ등록ㆍ협의ㆍ동의ㆍ심사 또는 해제 등(이하 "인ㆍ허가등"이라 한다)에 관하여 시장ㆍ군수ㆍ구청장이 인ㆍ허가등의 관계 행정기관의 장과 미리 협의한 사항에 대해서는 해당 인ㆍ허가등을 받거나 한 것으로 보며, 제16조제4항에 따른 실시계획의 승인 또는 고시가 있은 때에는 다음 각 호의 관계 법률에 따른 인ㆍ허가등의 고시ㆍ공고 등이 있은 것으로 본다. <개정 2014.1.14, 2014.6.3, 2016.1.19, 2016.12.27, 2017.1.17, 2017.11.28, 2020.2.11, 2020.3.31, 2021.7.20, 2021.11.30, 2022.12.27, 2023.7.25>

② 시장ㆍ군수ㆍ구청장은 실시계획의 승인을 하거나 실시계획을 작성하고자 할 때 제1항 각 호에 따라 의제되는 인ㆍ허가등에 해당하는 사항이 있는 경우에는 미리 관계 행정기관의 장과 협의하여야 한다. <개정 2023.7.25>

③ 제2항에도 불구하고 천재지변이나 그 밖의 불가피한 사유로 인하여 긴급히 정비사업을 시행할 필요가 있다고 시장ㆍ군수ㆍ구청장이 인정하는 때에는 관계 행정기관의 장과 협의를 마치기 전에 실시계획 승인을 할 수 있다. 이 경우 협의를 마칠 때까지는 제1항에 따른 인ㆍ허가등을 받은 것으로 보지 아니한다. <개정 2023.7.25>
