Act on the Prohibition of Chemical Weapons and Biological Weapons and the Regulation of Manufacture and Import/Export of Specified Chemicals and Biological Agents, Article 8 (Revocation of Permission for Manufacture of Schedule 1 Chemicals)
① 산업통상부장관은 허가제조자가 다음 각 호의 어느 하나에 해당하는 경우에는 제5조제1항에 따른 제조허가를 취소하거나 3개월 이내의 기간(이하 이 항에서 "제조정지기간"이라 한다)을 정하여 제조행위의 전부 또는 일부의 정지를 명(이하 이 항에서 "제조정지명령"이라 한다)할 수 있다. 다만, 제1호ㆍ제4호ㆍ제18호 또는 제19호에 해당하는 경우에는 그 허가를 취소하여야 한다. <개정 2013.3.23, 2022.2.3, 2025.10.1>
(1) Where a permitted manufacturer falls under any of the following, the Minister of Industry and Trade may revoke the manufacturing permission under Article 5 (1), or may order the suspension of all or part of manufacturing activities for a period of up to three months (hereinafter in this paragraph referred to as the "manufacturing suspension period") (hereinafter in this paragraph referred to as a "manufacturing suspension order"). However, in cases falling under subparagraph 1, 4, 18, or 19, the permission shall be revoked:
1. 거짓이나 그 밖의 부정한 방법으로 제5조제1항 전단에 따른 제조허가를 받은 경우
1. Where the manufacturing permission under the first sentence of Article 5 (1) was obtained by false or other improper means;
2. 거짓이나 그 밖의 부정한 방법으로 제5조제1항 후단 및 단서에 따른 변경허가를 받거나 변경신고를 한 경우 또는 같은 항 후단 및 단서에 따른 변경허가를 받지 아니하거나 변경신고를 하지 아니한 경우
2. Where permission for change or a report of change under the latter sentence and proviso of Article 5 (1) was obtained or made by false or other improper means, or where permission for change was not obtained or a report of change was not made under the latter sentence and proviso of the same paragraph;
3. 제5조제1항에 따른 허가 요건을 충족하지 못하게 된 경우
3. Where the permission requirements under Article 5 (1) are no longer satisfied;
4. 제6조 각 호의 어느 하나에 해당하게 된 경우
4. Where the person has come to fall under any subparagraph of Article 6;
5. 제7조제1항 및 제9조제1항에 따른 신고를 하지 아니한 경우
5. Where the person failed to make a report under Article 7 (1) or 9 (1);
6. 제10조제1항을 위반하여 1종화학물질을 폐기하지 아니한 경우
6. Where the person failed to dispose of Schedule 1 chemicals in violation of Article 10 (1);
7. 제10조제3항에 따른 신고를 하지 아니하거나 거짓으로 신고한 경우
7. Where the person failed to make a report under Article 10 (3) or made a false report;
8. 제10조제5항 전단에 따른 명령을 위반하여 1종화학물질을 폐기한 경우
8. Where the person disposed of Schedule 1 chemicals in violation of an order under the first sentence of Article 10 (5);
9. 거짓이나 그 밖의 부정한 방법으로 제11조제1항에 따른 허가 또는 변경허가를 받거나, 같은 항에 따른 허가 또는 변경허가를 받지 아니한 경우
9. Where permission or permission for change under Article 11 (1) was obtained by false or other improper means, or was not obtained;
10. 제11조제2항에 따른 신고를 하지 아니하거나 거짓으로 신고한 경우
10. Where the person failed to make a report under Article 11 (2) or made a false report;
11. 거짓이나 그 밖의 부정한 방법으로 제12조제1항에 따른 허가 또는 변경허가를 받거나, 같은 항에 따른 허가 또는 변경허가를 받지 아니한 경우
11. Where permission or permission for change under Article 12 (1) was obtained by false or other improper means, or was not obtained;
12. 제12조제2항에 따른 신고를 하지 아니하거나 거짓으로 신고한 경우
12. Where the person failed to make a report under Article 12 (2) or made a false report;
13. 제13조제1항 또는 제3항에 따른 신고를 하지 아니하거나 거짓으로 신고한 경우
13. Where the person failed to make a report under Article 13 (1) or (3) or made a false report;
14. 제17조제4항을 위반하여 국제사찰을 거부ㆍ방해하거나 기피한 경우
14. Where the person refused, obstructed, or evaded international inspection in violation of Article 17 (4);
15. 제18조제2항을 위반하여 행정감독상 필요한 조치를 거부ㆍ방해하거나 기피한 경우
15. Where the person refused, obstructed, or evaded measures necessary for administrative supervision in violation of Article 18 (2);
16. 제21조제1항 및 제2항을 위반하여 장부를 비치ㆍ기록ㆍ유지 또는 보존하지 아니하거나 거짓으로 기록한 경우 또는 자료를 보존하지 아니한 경우
16. Where the person failed to keep, record, maintain, or preserve books, or made false entries, or failed to preserve data, in violation of Article 21 (1) and (2);
17. 제21조제3항에 따른 자료의 제출을 하지 아니하거나 거짓 자료를 제출한 경우 또는 거짓으로 답변을 한 경우
17. Where the person failed to submit data under Article 21 (3), submitted false data, or gave false answers;
18. 제조정지기간에 제조행위를 한 경우
18. Where the person engaged in manufacturing activities during the manufacturing suspension period; and
19. 최근 1년간 2회의 제조정지명령을 받은 자가 다시 제2호ㆍ제3호 및 제5호부터 제17호까지의 어느 하나에 해당하게 된 경우
19. Where a person who received two manufacturing suspension orders within the most recent year again falls under any of subparagraphs 2, 3, and 5 through 17.
② 산업통상부장관은 허가제조자가 다음 각 호의 어느 하나에 해당하는 경우에는 상속을 개시한 날이나 법인이 제6조제6호에 해당하게 된 날부터 3개월 동안은 제1항을 적용하지 아니한다. <개정 2013.3.23, 2025.10.1>
(2) The Minister of Industry and Trade shall not apply paragraph (1) for three months from the date inheritance commenced or the date the corporation came to fall under Article 6, subparagraph 6, where a permitted manufacturer falls under any of the following:
1. 허가제조자의 지위를 승계한 상속인이 제6조 각 호의 어느 하나에 해당하게 된 경우
1. Where an heir who succeeded to the status of the permitted manufacturer has come to fall under any subparagraph of Article 6; and
2. 법인이 제6조제6호에 해당하게 된 경우
2. Where a corporation has come to fall under Article 6, subparagraph 6.
