(1) The head of a local government may sell general property by private contract pursuant to the proviso to Article 29 (1) of the Act in any of the following cases:
1. 국가나 다른 지방자치단체가 공용 또는 공공용으로 사용하려는 경우
1. Where the State or another local government intends to use it for official or public use;
2. 제29조제5항제3호에 따른 대부계약의 조건에 따라 대부재산을 대부받은 자에게 매각하는 경우

4. Where there is only one owner of land adjacent to land without a building that falls short of the minimum subdivision area under Article 57 (1) of the Building Act, and the land is sold to that adjacent landowner;
5. 지방자치단체가 건립한 아파트ㆍ연립주택ㆍ공영주택 및 그 부지를 국가보훈부장관이 지정하는 국가유공자 또는 「국민기초생활 보장법」에 따른 수급자에게 매각하는 경우
5. Where apartments, row houses, public housing built by a local government and their sites are sold to persons of distinguished service to the State designated by the Minister of Patriots and Veterans Affairs or recipients under the National Basic Living Security Act;

7. Where property to be used as a site for housing or public-use facilities is sold to village residents in order to support or encourage a living environment improvement project under the Agricultural and Fishing Villages Improvement Act, and where property is sold to a residents' organization to install facilities for joint use by residents;
8. 외교상 또는 국방상의 이유로 재산의 매각을 비밀리에 할 필요가 있는 경우
8. Where it is necessary to sell property secretly for diplomatic or national defense reasons;
9. 천재지변이나 그 밖의 재해가 발생하여 재해복구 또는 구호의 목적으로 재산을 처분하는 경우
9. Where property is disposed of for the purpose of disaster recovery or relief due to a natural disaster or other disaster;
10. 「수도권정비계획법 시행령」 제3조제1호부터 제3호까지 및 제5호에 따른 수도권 인구집중유발시설을 지방으로 이전하기 위하여 해당 시설을 이전하는 자에게 재산을 매각하는 경우
10. Where property is sold to a person who relocates facilities inducing population concentration in the Seoul metropolitan area under Article 3, subparagraphs 1 through 3 and 5 of the Enforcement Decree of the Seoul Metropolitan Area Readjustment Planning Act, in order to relocate the facilities to provincial areas;
11. 주식의 매각을 투자매매업자ㆍ투자중개업자에게 위탁하는 경우
11. Where sale of shares is entrusted to an investment trader or investment broker;
12. 지방자치단체가 취급하던 업무를 해당 지방자치단체 외의 자에게 포괄하여 이관하면서 이관되는 업무에 제공되고 있던 재산을 이관받는 자에게 매각하는 경우
12. Where, upon comprehensively transferring duties handled by a local government to a person other than the relevant local government, property provided for the transferred duties is sold to the person receiving the transfer;
13. 지방자치단체가 유아교육 또는 아동복지사업을 지원하기 위하여 유아교육 또는 아동복지사업을 하는 사회복지법인 또는 「공익법인의 설립ㆍ운영에 관한 법률」을 적용받는 어린이육영단체에 재산을 매각하는 경우
13. Where a local government sells property to a social welfare corporation engaged in early childhood education or child welfare projects, or a children's nurturing organization subject to the Act on the Establishment and Operation of Public-Interest Corporations, in order to support early childhood education or child welfare projects;
14. 다음 각 목의 어느 하나에 해당하는 기관에 그 목적사업에 필요한 재산을 매각하는 경우
14. Where property necessary for the institution's purpose business is sold to an institution falling under any of the following items:
가. 「지방공기업법」에 따라 설립된 법인
(a) A corporation established under the Local Public Enterprises Act;
나. 「공공기관의 운영에 관한 법률」 제4조제1항제1호부터 제3호까지의 규정에 따른 기관 중 재정경제부장관이 공공기관으로 지정한 기관(이하 "공공기관"이라 한다)
(b) An institution designated as a public institution by the Minister of Economy and Finance among institutions under Article 4 (1) 1 through 3 of the Act on the Management of Public Institutions (hereinafter referred to as a "public institution");
다. 「공무원연금법」에 따라 설립된 공무원연금공단
(c) The Government Employees Pension Service established under the Public Officials Pension Act;
라. 「대한지방행정공제회법」에 따라 설립된 대한지방행정공제회
(d) The Korea Local Administration Mutual Aid Association established under the Korea Local Administration Mutual Aid Association Act;
마. 「방송법」에 따른 한국방송공사
(e) The Korean Broadcasting System under the Broadcasting Act;
바. 「한국교육방송공사법」에 따른 한국교육방송공사
(f) The Korea Educational Broadcasting System under the Korea Educational Broadcasting System Act;
사. 「전자정부법」에 따라 설립된 한국지역정보개발원
(g) The Korea Local Information Research and Development Institute established under the Electronic Government Act;
15. 다른 법률에 따라 해당 재산을 양여하거나 무상으로 대부할 수 있는 자에게 그 재산을 매각하는 경우
15. Where property is sold to a person to whom the relevant property may be granted or leased free of charge under other laws;
16. 「국토의 계획 및 이용에 관한 법률」 제97조에 따라 용도가 정해진 토지를 그 정해진 목적에 사용하도록 해당 도시ㆍ군계획사업시행자에게 매각하는 경우
16. Where land whose use is designated under Article 97 of the National Land Planning and Utilization Act is sold to the implementer of the relevant urban and Gun planning project to be used for the designated purpose;
17. 국가보훈부장관이 지정하는 국가유공자 집단복지공장이 직접 사용할 업무용 토지를 매각하는 경우
17. Where business land to be used directly by a collective welfare factory for persons of distinguished service to the State designated by the Minister of Patriots and Veterans Affairs is sold;
18. 「농어촌정비법」 제82조에 따른 농어촌 관광휴양단지로 조성된 재산을 농어민에게 매각하는 경우
18. Where property created as a rural tourism and recreation complex under Article 82 of the Agricultural and Fishing Villages Improvement Act is sold to farmers and fishers;
19. 「농어촌정비법」 제78조제1항에 따른 농공단지사업을 시행하는 자에게 해당 사업에 사용할 토지를 매각하는 경우
19. Where land to be used for an agro-industrial complex project is sold to a person implementing the agro-industrial complex project under Article 78 (1) of the Agricultural and Fishing Villages Improvement Act;

21. 「도서ㆍ벽지 교육진흥법」에 따른 도서ㆍ벽지에 있는 학교를 폐지하는 경우 그 학교재산을 청소년교육과 지역주민의 복리증진사업을 위하여 다음 각 목의 어느 하나에 해당하는 자에게 매각하는 경우
21. Where a school in an island or remote area under the Act on the Promotion of Education in Islands and Remote Areas is abolished and the school property is sold, for youth education and projects to promote the welfare of local residents, to a person falling under any of the following items:
나. 「사회복지사업법」 제2조제3호에 따른 사회복지법인
(b) A social welfare corporation under Article 2, subparagraph 3 of the Social Welfare Services Act;
다. 「공익법인의 설립ㆍ운영에 관한 법률」 제2조에 따른 공익법인
(c) A public-interest corporation under Article 2 of the Act on the Establishment and Operation of Public-Interest Corporations;
라. 그 밖의 비영리법인
(d) Other non-profit corporations;
22. 제21호에 따른 도서ㆍ벽지 외의 읍ㆍ면 지역에 있는 학교를 폐지하고 그 학교재산을 학교법인에 매각하는 경우
22. Where a school in a Eup or Myeon area other than an island or remote area under subparagraph 21 is abolished and the school property is sold to a school corporation;
23. 재산의 위치ㆍ형태ㆍ용도 등으로 보아 일반입찰에 부치기 곤란하거나 계약의 목적 또는 성질상 수의계약으로 하는 것이 불가피한 경우로서 지방자치단체의 조례로 그 내용 및 범위를 정한 경우
23. Where it is difficult to put the property up for general bidding in view of the location, form, and use of the property, or where private contract is unavoidable owing to the purpose or nature of the contract, and the contents and scope are prescribed by ordinance of the local government;

26. 「장사 등에 관한 법률」 제2조제9호에 따른 봉안시설의 설치를 위하여 재산을 매각하는 경우
26. Where property is sold for installing an enshrinement facility under Article 2, subparagraph 9 of the Act on Funeral Services, etc.;
27. 동일인 소유의 사유지에 둘러싸여 고립된 토지를 그 사유지의 소유자에게 매각하는 경우
27. Where land isolated by being surrounded by private land of the same owner is sold to the owner of that private land;
28. 지역경제를 활성화하기 위하여 지방자치단체의 조례로 정하는 기준에 적합한 시설로서 해당 지역에 거주하는 상시 종업원을 30명 이상 신규 채용하거나 원자재의 30퍼센트 이상을 해당 지역에서 조달하려는 기업의 공장 또는 연구시설을 유치하기 위하여 매각하는 경우
28. Where a factory or research facility of an enterprise that meets the standards prescribed by ordinance of the local government in order to revitalize the local economy and that intends to newly hire 30 or more regular employees residing in the relevant region, or to procure 30 percent or more of raw materials from the relevant region, is attracted by sale;
29. 「주택법」에 따른 주택건설사업에 편입되는 토지를 행정안전부장관이 정하는 기준에 따라 매각하는 경우
29. Where land incorporated into a housing construction project under the Housing Act is sold according to standards determined by the Minister of the Interior and Safety;
30. 「사립학교법」 제2조제2항에 따른 학교법인에 「초ㆍ중등교육법」 제2조에 따른 학교 또는 「고등교육법」 제2조에 따른 학교의 설립에 필요한 부지를 매각하는 경우
30. Where a site necessary for establishing a school under Article 2 of the Elementary and Secondary Education Act or a school under Article 2 of the Higher Education Act is sold to a school corporation under Article 2 (2) of the Private School Act;
31. 지방자치단체와 해당 지방자치단체 외의 자가 공유하고 있는 일반재산인 토지를 그 토지를 공유하고 있는 자에게 매각하는 경우로서 다음 각 목의 요건을 모두 갖춘 경우
31. Where land that is general property co-owned by a local government and a person other than the relevant local government is sold to the co-owner and all of the following requirements are met:
가. 지방자치단체가 소유한 지분의 면적이 다음의 구분에 따른 면적 이하일 것
(a) The area of the share owned by the local government is no more than the area according to the following classification:
1) 토지가 특별시, 통합특별시(자치구만 해당한다) 또는 광역시에 소재하는 경우: 300제곱미터 이하
1) Where the land is located in a Special Metropolitan City, an Integrated Special City (limited to autonomous Gus), or a Metropolitan City: 300 square meters or less;
2) 토지가 통합특별시(자치구는 제외한다), 특별자치시, 도 또는 특별자치도의 동(洞)지역에 소재하는 경우: 500제곱미터 이하
2) Where the land is located in a Dong area of an Integrated Special City (excluding autonomous Gus), Special Self-Governing City, Do, or Special Self-Governing Province: 500 square meters or less;
3) 토지가 통합특별시, 특별자치시, 도 또는 특별자치도의 읍ㆍ면 지역에 소재하는 경우: 1천제곱미터 이하
3) Where the land is located in a Eup or Myeon area of an Integrated Special City, Special Self-Governing City, Do, or Special Self-Governing Province: 1,000 square meters or less;
나. 지방자치단체 외의 자의 공유지분율이 50퍼센트 이상일 것
(b) The co-ownership share ratio of the person other than the local government is 50 percent or more;
32. 사유지에 건축되거나 설치된 지방자치단체 소유의 건물이나 공작물로서 그 건물이나 공작물의 위치, 규모, 형태 및 용도 등을 고려하여 해당 재산을 그 사유지의 소유자에게 매각하는 경우
32. Where a building or structure owned by a local government that has been built or installed on private land is sold to the owner of that private land, in view of the location, scale, form, and use of the building or structure;
33. 지식재산의 내용상 그 실시(「특허법」 제2조제3호, 「실용실안법」 제2조제3호 및 「디자인보호법」 제2조제7호에 따른 실시를 말한다. 이하 같다)에 특정인의 기술이나 설비가 필요하여 일반입찰에 부치기 곤란한 경우
33. Where it is difficult to put intellectual property up for general bidding because working it (meaning working under Article 2, subparagraph 3 of the Patent Act, Article 2, subparagraph 3 of the Utility Model Act, and Article 2, subparagraph 7 of the Design Protection Act; the same applies hereinafter) requires the technology or equipment of a specific person owing to the content of the intellectual property;
34. 「지방자치분권 및 지역균형발전에 관한 특별법 시행령」 제44조의2제1항에 따라 지방자치단체가 자금을 출자한 대상의 주주 등 출자자에게 그 대상의 지분증권을 매각하는 경우
34. Where equity securities of an entity in which a local government has invested funds under Article 44-2 (1) of the Enforcement Decree of the Special Act on Local Autonomy Decentralization and Balanced Regional Development are sold to investors such as shareholders of that entity;
35. 「지방자치분권 및 지역균형발전에 관한 특별법 시행령」 제44조의2제1항제2호에 따라 지방자치단체가 자금을 출자한 대상 중 주식회사에 그 목적사업에 필요한 재산을 행정안전부장관이 정하여 고시하는 기준에 따라 매각하는 경우
35. Where property necessary for its purpose business is sold, according to standards determined and publicly notified by the Minister of the Interior and Safety, to a stock company among entities in which a local government has invested funds under Article 44-2 (1) 2 of the Enforcement Decree of the Special Act on Local Autonomy Decentralization and Balanced Regional Development.

(2) Notwithstanding paragraph (1), property that is the subject of a de facto or litigation dispute between parties with conflicting interests that is extremely difficult to resolve over a long period, or property recognized as difficult to sell by private contract, shall be sold by general bidding.
