Act on the Prohibition of Chemical Weapons and Biological Weapons and the Regulation of Manufacture and Import/Export of Specified Chemicals and Biological Agents, Article 8-2 (Suspension of Manufacture of Biological Agents, etc.)
① 산업통상부장관은 신고제조자가 다음 각 호의 어느 하나에 해당하는 경우에는 3개월 이내의 기간(이하 이 항에서 "제조정지기간"이라 한다)을 정하여 제조행위의 전부 또는 일부의 정지를 명(이하 이 항에서 "제조정지명령"이라 한다)하거나 제조시설의 폐쇄를 명(이하 이 항에서 "제조폐쇄명령"이라 한다)할 수 있다. 다만, 제1호ㆍ제3호ㆍ제16호 또는 제17호에 해당하는 경우에는 제조폐쇄명령을 하여야 한다. <개정 2013.3.23, 2017.10.31, 2022.2.3, 2025.10.1>
(1) Where a reporting manufacturer falls under any of the following, the Minister of Industry and Trade may order the suspension of all or part of manufacturing activities for a period of up to three months (hereinafter in this paragraph referred to as the "manufacturing suspension period") (hereinafter in this paragraph referred to as a "manufacturing suspension order"), or order the closure of manufacturing facilities (hereinafter in this paragraph referred to as a "manufacturing closure order"). However, in cases falling under subparagraph 1, 3, 16, or 17, a manufacturing closure order shall be issued:
1. 거짓이나 그 밖의 부정한 방법으로 제5조의2제1항 전단에 따른 신고를 하거나, 신고를 하지 아니하고 생물작용제등을 제조한 경우
1. Where the person made a report under the first sentence of Article 5-2 (1) by false or other improper means, or manufactured biological agents, etc. without making a report;
2. 제5조의2제1항 후단에 따른 변경신고를 하지 아니하거나 거짓으로 변경신고한 경우
2. Where the person failed to make a report of change under the latter sentence of Article 5-2 (1) or made a false report of change;
3. 제6조 각 호의 결격사유 중 어느 하나에 해당하게 된 경우
3. Where the person has come to fall under any ground for disqualification in the subparagraphs of Article 6;
4. 제7조제1항 및 제9조제1항에 따른 신고를 하지 아니한 경우
4. Where the person failed to make a report under Article 7 (1) or 9 (1);
5. 제10조제1항을 위반하여 생물작용제등을 폐기하지 아니한 경우
5. Where the person failed to dispose of biological agents, etc. in violation of Article 10 (1);
6. 제10조제3항에 따른 신고를 하지 아니하거나 거짓으로 신고한 경우
6. Where the person failed to make a report under Article 10 (3) or made a false report;
7. 제10조제5항 전단에 따른 명령을 위반하여 생물작용제등을 폐기한 경우
7. Where the person disposed of biological agents, etc. in violation of an order under the first sentence of Article 10 (5);
8. 거짓이나 그 밖의 부정한 방법으로 제11조제1항에 따른 허가 또는 변경허가를 받거나, 같은 항에 따른 허가 또는 변경허가를 받지 아니한 경우
8. Where permission or permission for change under Article 11 (1) was obtained by false or other improper means, or was not obtained;
9. 제11조제2항에 따른 신고를 하지 아니하거나 거짓으로 신고한 경우
9. Where the person failed to make a report under Article 11 (2) or made a false report;
10. 거짓이나 그 밖의 부정한 방법으로 제12조제1항에 따른 허가(제12조제6항 각 호의 어느 하나에 해당하는 허가를 포함한다) 또는 변경허가를 받거나, 같은 항에 따른 허가 또는 변경허가를 받지 아니한 경우
10. Where permission (including permission falling under any subparagraph of Article 12 (6)) or permission for change under Article 12 (1) was obtained by false or other improper means, or was not obtained;
11. 제12조제2항에 따른 신고를 하지 아니하거나 거짓으로 신고한 경우
11. Where the person failed to make a report under Article 12 (2) or made a false report;
12. 제13조의2에 따른 신고를 하지 아니하거나 거짓으로 신고한 경우
12. Where the person failed to make a report under Article 13-2 or made a false report;
13. 제18조의2에 따른 정기검사 또는 수시검사를 거부ㆍ방해하거나 기피한 경우
13. Where the person refused, obstructed, or evaded a regular or occasional inspection under Article 18-2;
14. 제21조제1항 및 제2항을 위반하여 장부를 비치ㆍ기록ㆍ유지 또는 보존하지 아니하거나 거짓으로 기록한 경우 또는 자료를 보존하지 아니한 경우
14. Where the person failed to keep, record, maintain, or preserve books, or made false entries, or failed to preserve data, in violation of Article 21 (1) and (2);
15. 제21조제3항에 따른 자료의 제출을 하지 아니하거나 거짓 자료를 제출한 경우 또는 거짓으로 답변을 한 경우
15. Where the person failed to submit data under Article 21 (3), submitted false data, or gave false answers;
16. 제조정지기간에 제조행위를 한 경우
16. Where the person engaged in manufacturing activities during the manufacturing suspension period; and
17. 최근 1년간 2회의 제조정지명령을 받은 자가 다시 제2호 및 제4호부터 제15호까지의 어느 하나에 해당하게 된 경우
17. Where a person who received two manufacturing suspension orders within the most recent year again falls under any of subparagraph 2 and subparagraphs 4 through 15.
② 신고제조자에 관하여는 제8조제2항을 준용한다.
(2) Article 8 (2) applies mutatis mutandis to reporting manufacturers.
