Wastes Control Act, Article 27 (Revocation of Permits, etc.)
① 기후에너지환경부장관이나 시ㆍ도지사는 폐기물처리업자가 다음 각 호의 어느 하나에 해당하면 그 허가(변경허가 및 변경신고를 포함한다. 이하 이 조에서 같다)를 취소하여야 한다. <개정 2013.7.16, 2015.1.20, 2019.11.26, 2020.5.26, 2025.10.1>
(1) The Minister of Climate, Energy and Environment or a Mayor/Do Governor shall revoke the permit (including a permit of change and a report of change; hereinafter the same shall apply in this Article) of a waste treatment business operator if the operator falls under any of the following:
1. 속임수나 그 밖의 부정한 방법으로 허가를 받은 경우
1. Where the operator obtained the permit by deception or other improper means;
1의2. 제25조의3제1항에 따른 적합성확인을 받지 아니한 경우
1-2. Where the operator did not obtain suitability confirmation under Article 25-3 (1);
1의3. 속임수나 그 밖의 부정한 방법으로 제25조의3제1항에 따른 적합성 확인을 받은 경우
1-3. Where the operator obtained suitability confirmation under Article 25-3 (1) by deception or other improper means;
2. 제26조 각 호의 결격사유 중 어느 하나에 해당되는 경우. 다만, 다음 각 목의 어느 하나에 해당하는 경우 그 구분에 따른 조치를 한 경우는 제외한다.
2. Where the operator falls under any ground for disqualification in the subparagraphs of Article 26: Provided, That this shall not apply where the operator has taken the measures corresponding to any of the following items:
가. 임원 또는 사용인 중 제26조제6호에 해당하는 자가 있는 경우: 결격사유가 발생한 날부터 2개월 이내에 그 임원 또는 사용인을 바꾸어 임명
(a) Where an officer or employee falls under Article 26, subparagraph 6: Replacing the officer or employee within two months from the date the ground for disqualification arose; and
나. 제33조제3항에 따라 권리ㆍ의무를 승계한 상속인이 제26조 각 호의 어느 하나에 해당하는 경우: 상속이 시작된 날부터 6개월 이내에 그 권리ㆍ의무를 다른 자에게 양도
(b) Where an heir who succeeded to rights and obligations under Article 33 (3) falls under any subparagraph of Article 26: Transferring the rights and obligations to another person within six months from the date inheritance began;
3. 제40조제1항 본문에 따른 조치를 하지 아니한 경우
3. Where the operator has failed to take measures under the main clause of Article 40 (1);
4. 제40조제8항에 따른 계약 갱신 명령을 이행하지 아니한 경우
4. Where the operator has failed to comply with an order to renew a contract under Article 40 (8);
5. 영업정지기간 중 영업 행위를 한 경우
5. Where the operator conducted business during a period of business suspension.
② 기후에너지환경부장관이나 시ㆍ도지사는 폐기물처리업자가 다음 각 호의 어느 하나에 해당하면 그 허가를 취소하거나 6개월 이내의 기간을 정하여 영업의 전부 또는 일부의 정지를 명령할 수 있다. <개정 2010.7.23, 2015.1.20, 2015.7.20, 2017.4.18, 2019.4.16, 2019.11.26, 2021.1.5, 2025.10.1>
(2) The Minister of Climate, Energy and Environment or a Mayor/Do Governor may revoke the permit of a waste treatment business operator or order suspension of all or part of its business for a specified period not exceeding six months if the operator falls under any of the following:
1. 제8조제1항 또는 제2항을 위반하여 사업장폐기물을 버리거나 매립 또는 소각한 경우
1. Where the operator dumped, landfilled, or incinerated business-site waste in violation of Article 8 (1) or (2);
2. 제13조 또는 제13조의2를 위반하여 폐기물을 처리한 경우
2. Where the operator treated waste in violation of Article 13 or 13-2;
2의2. 제13조의5제5항에 따른 조치명령을 이행하지 아니한 경우
2-2. Where the operator has failed to comply with an order for measures under Article 13-5 (5);
2의3. 제14조의5제2항을 위반하여 안전기준을 준수하지 아니한 경우
2-3. Where the operator has failed to observe safety standards, in violation of Article 14-5 (2);
3. 제18조제3항을 위반하여 폐기물의 인계ㆍ인수에 관한 사항과 폐기물처리현장정보를 전자정보처리프로그램에 입력하지 아니한 경우
3. Where the operator has failed to enter matters concerning the handover and acceptance of waste and waste treatment site information into the electronic information processing program, in violation of Article 18 (3);
3의2. 제18조의2제4항을 위반하여 유해성 정보자료를 게시하지 아니하거나 비치하지 아니한 경우
3-2. Where the operator has failed to post or keep hazard information materials, in violation of Article 18-2 (4);
4. 제19조제1항을 위반하여 관계 행정기관이나 그 소속 공무원이 요구하여도 인계번호를 알려주지 아니한 경우
4. Where the operator has failed to tell the handover number even when requested by a relevant administrative agency or its public officials, in violation of Article 19 (1);
5. 제25조제5항에 따른 업종 구분과 영업 내용의 범위를 벗어나는 영업을 한 경우
5. Where the operator conducted business beyond the scope of the classification and business content of types of business under Article 25 (5);
6. 제25조제7항에 따른 조건을 위반한 경우
6. Where the operator violated the conditions under Article 25 (7);
7. 제25조제8항을 위반하여 다른 사람에게 자기의 성명이나 상호를 사용하여 폐기물을 처리하게 하거나 그 허가증을 다른 사람에게 빌려 준 경우
7. Where the operator allowed another person to treat waste using its name or trade name, or lent the permit to another person, in violation of Article 25 (8);
8. 제25조제9항을 위반하여 폐기물을 보관하거나 준수사항을 위반한 경우. 다만, 같은 항 제5호에 해당하는 경우에는 고의 또는 중과실인 경우에 한정한다.
8. Where the operator stored waste or violated compliance requirements, in violation of Article 25 (9): Provided, That in the case of subparagraph 5 of that paragraph, this is limited to cases of intent or gross negligence;
9. 제25조제10항을 위반하여 별도로 수집ㆍ운반ㆍ처분하는 시설ㆍ장비 및 사업장을 설치ㆍ운영하지 아니한 경우
9. Where the operator has failed to install and operate facilities, equipment, and a business site for separate collection, transport, and disposal, in violation of Article 25 (10);
10. 제25조제11항에 따른 변경허가를 받거나 변경신고를 하지 아니하고 허가사항이나 신고사항을 변경한 경우
10. Where the operator changed permitted or reported matters without obtaining a permit of change or filing a report of change under Article 25 (11);
11. 제30조제1항ㆍ제2항을 위반하여 검사를 받지 아니하거나 같은 조 제3항을 위반하여 적합판정을 받지 아니한 폐기물처리시설을 사용한 경우
11. Where the operator used a waste treatment facility that has not undergone an inspection, in violation of Article 30 (1) or (2), or has not received a pass determination, in violation of paragraph (3) of that Article;
12. 제31조제1항에 따른 관리기준에 맞지 아니하게 폐기물처리시설을 운영한 경우
12. Where the operator operated a waste treatment facility in a manner not conforming to the management standards under Article 31 (1);
13. 제31조제4항에 따른 개선명령이나 사용중지명령을 이행하지 아니한 경우
13. Where the operator has failed to comply with an improvement order or order to suspend use under Article 31 (4);
14. 제31조제5항에 따른 폐쇄명령을 이행하지 아니한 경우
14. Where the operator has failed to comply with a closure order under Article 31 (5);
15. 제31조제7항에 따른 측정명령이나 조사명령을 이행하지 아니한 경우
15. Where the operator has failed to comply with a measurement order or investigation order under Article 31 (7);
15의2. 제33조제1항 또는 제2항에 따른 권리ㆍ의무의 승계를 위한 허가신청을 하지 아니하거나 허가를 받지 못한 경우
15-2. Where the operator has failed to apply for a permit for succession to rights and obligations under Article 33 (1) or (2), or failed to obtain the permit;
16. 제33조제3항에 따른 권리ㆍ의무의 승계신고를 하지 아니하거나 승계신고가 수리되지 아니한 경우
16. Where the operator has failed to file a report of succession to rights and obligations under Article 33 (3), or the report of succession has not been accepted;
17. 제36조제1항을 위반하여 장부를 기록ㆍ보존하지 아니한 경우
17. Where the operator has failed to record and preserve ledgers, in violation of Article 36 (1);
17의2. 제36조제3항을 위반하여 장부에 기록하고 보존하여야 하는 폐기물의 발생ㆍ배출ㆍ처리상황 등을 전자정보처리프로그램에 입력하지 아니하거나 거짓으로 입력한 경우
17-2. Where the operator has failed to enter, or has falsely entered, into the electronic information processing program the generation, discharge, and treatment status, etc. of waste required to be recorded and preserved in the ledger, in violation of Article 36 (3);
18. 제39조의3, 제40조제2항ㆍ제3항, 제47조의2 또는 제48조에 따른 명령을 이행하지 아니한 경우
18. Where the operator has failed to comply with an order under Article 39-3, 40 (2) or (3), 47-2, or 48;
19. 제52조제1항에 따라 사후관리이행보증금을 사전에 적립하지 아니한 경우
19. Where the operator has failed to set aside in advance the post-management performance deposit, in violation of Article 52 (1); and
20. 허가를 받은 후 1년 이내에 영업을 시작하지 아니하거나 정당한 사유 없이 계속하여 1년 이상 휴업한 경우
20. Where the operator did not begin business within one year after obtaining the permit, or suspended business continuously for one year or more without justifiable reason.
