산림조합법 제86조의10(준용규정)

① 조합공동사업법인에 관하여는 제13조제3항, 제17조, 제20조부터 제23조까지, 제25조부터 제31조까지, 제31조의2부터 제31조의6까지, 제33조, 제37조, 제41조부터 제43조까지, 제53조, 제55조의2, 제56조의2, 제56조의3제1항ㆍ제2항, 제56조의4, 제56조의5(제2호는 제외한다), 제57조부터 제60조까지, 제67조부터 제79조까지, 제81조부터 제86조까지의 규정을 준용한다. 이 경우 "조합"은 "조합공동사업법인"으로, "조합장"은 "대표이사"로, "조합원"은 "회원"으로, "시ㆍ도지사"는 "산림청장"으로 보고, 제25조제2항 중 "조합원 또는 본인과 동거하는 가족(법인의 경우에는 사원 등 그 구성원을 말한다)이어야 하며, 대리인이 대리할 수 있는 조합원의 수는 1명으로 한정한다"는 "회원이어야 하며, 대리인은 회원의 의결권 수에 따라 대리할 수 있다"로, 제31조제4항 본문 중 "조합원 과반수의 출석으로 개의하고 출석조합원 과반수의 찬성"은 "의결권 총수의 과반수에 해당하는 회원의 출석으로 개의하고 출석한 회원의 의결권 과반수의 찬성"으로, 같은 항 단서 중 "조합원 과반수의 출석과 출석조합원 3분의 2 이상의 찬성"은 "의결권 총수의 과반수에 해당하는 회원의 출석과 출석한 회원의 의결권 3분의 2 이상의 찬성"으로, 제31조제5항제2호 및 제31조의2제1항제1호 중 "해산 또는 분할"은 "해산"으로, 제31조의5제1항 단서 중 "조합원 과반수의 출석과 출석조합원 3분의 2 이상의 찬성"은 "의결권 총수의 과반수에 해당하는 회원의 출석과 출석한 회원의 의결권 3분의 2 이상의 찬성"으로, 제31조의6제2항 중 "3인"은 "2인"으로, 제41조제3항 중 "다른 조합"은 "다른 조합공동사업법인"으로, 제56조의3제2항 중 "법정적립금, 이월금"은 "법정적립금"으로 본다. <개정 2020.2.18>

② 조합공동사업법인의 우선출자에 관하여는 제60조의2부터 제60조의6까지의 규정을 준용한다. 이 경우 "조합"은 "조합공동사업법인"으로, "조합원"은 "회원"으로 보고, 제60조의2제2항 중 "제20조제3항"은 "제86조의10제1항에 따라 준용되는 제20조제3항"으로 본다.
