영화 및 비디오물의 진흥에 관한 법률 제63조(영업의 승계)

① 제57조 또는 제58조에 따라 신고 또는 등록을 한 비디오물제작업자, 비디오물배급업자 또는 비디오물시청제공업자(이하 "비디오물제작업자등"이라 한다)가 그 영업을 양도하거나 사망한 경우 또는 다른 법인과 합병한 경우에 그 양수인ㆍ상속인 또는 합병으로 설립되거나 합병 후 존속하는 법인이 종전의 비디오물제작업자등의 지위를 승계하려는 경우에는 그 양도일, 상속일 또는 합병일부터 30일 이내에 문화체육관광부령으로 정하는 바에 따라 그 사실을 관할 시장ㆍ군수ㆍ구청장에게 신고하여야 한다.

② 다음 각 호의 어느 하나에 해당하는 절차에 따라 비디오물제작업자등의 비디오물에 관한 영업시설ㆍ기구(대통령령으로 정하는 주요시설ㆍ기구를 말한다. 이하 같다)의 전부를 인수한 자가 종전의 비디오물제작업자등의 지위를 승계하려는 경우에는 그 인수일부터 30일 이내에 문화체육관광부령으로 정하는 바에 따라 그 사실을 관할 시장ㆍ군수ㆍ구청장에게 신고하여야 한다.

③ 시장ㆍ군수ㆍ구청장은 제58조에 따라 등록을 한 비디오물시청제공업자에 관하여 제1항 또는 제2항에 따른 신고를 받은 경우 그 내용을 검토하여 이 법에 적합하면 신고를 수리하여야 한다. <개정 2025.3.25>

④ 시장ㆍ군수ㆍ구청장이 제1항 또는 제2항에 따라 비디오물제작업자 또는 비디오물배급업자의 신고를 받거나 비디오물시청제공업자의 신고를 수리한 경우에는 양수인, 상속인, 합병으로 설립되거나 합병 후 존속하는 법인 또는 비디오물에 관한 영업시설ㆍ기구의 전부를 인수한 자는 그 양수일, 상속일, 합병일 또는 인수일부터 종전의 비디오물제작업자등의 지위를 승계한다. <개정 2025.3.25>

⑤ 제64조에 따른 폐업신고에 의하여 폐업하거나 등록이 말소된 비디오물제작업자등이 1년 이내에 폐업한 장소에서 같은 업종으로 다시 신고 또는 등록을 하는 경우 해당 비디오물제작업자등은 폐업신고 전의 비디오물제작업자등의 지위를 승계한다.
