빈집 및 소규모주택 정비에 관한 특례법 제35조(매도청구)

① 가로주택정비사업(제35조의2에 따라 토지ㆍ물건 및 권리를 수용 또는 사용할 수 있는 경우는 제외한다) 또는 소규모재건축사업의 사업시행자(토지등소유자가 시행하는 경우는 제외한다)는 제26조에 따른 심의 결과를 받은 날부터 30일 이내에 다음 각 호의 자에게 조합설립 또는 사업시행자의 지정에 동의할 것인지 여부를 회답할 것을 서면으로 촉구하여야 한다. <개정 2021.7.20>

② 제22조제2항제1호에 따른 자율주택정비사업의 사업시행자는 주민합의체 구성에 동의하지 아니한 자에 대하여 주민합의체 구성에 동의할 것인지 여부를 회답할 것을 서면으로 촉구하여야 한다. <신설 2021.7.20, 2025.8.26>

③ 제1항 또는 제2항의 촉구를 받은 토지등소유자는 촉구를 받은 날부터 60일 이내에 회답하여야 한다. <개정 2021.7.20>

④ 제3항의 기간 내에 회답하지 아니한 토지등소유자는 주민합의체 구성, 조합설립 또는 사업시행자의 지정에 동의하지 아니하겠다는 뜻을 회답한 것으로 본다. <개정 2021.7.20>

⑤ 사업시행자는 제3항에 따른 기간이 만료된 때부터 60일 이내에 주민합의체 구성, 조합설립 또는 사업시행자 지정에 동의하지 아니하겠다는 뜻을 회답한 토지등소유자와 건축물 또는 토지만 소유한 자에게 건축물 또는 토지의 소유권과 그 밖의 권리를 매도할 것을 청구할 수 있다. <개정 2021.7.20>
