도로교통법 제138조(운전면허증등의 보관)

① 경찰공무원은 자동차등의 운전자가 다음 각 호의 어느 하나에 해당하는 경우에는 현장에서 제164조에 따른 범칙금 납부통고서 또는 출석지시서를 발급하고, 운전면허증등의 제출을 요구하여 이를 보관할 수 있다. 이 경우 그 범칙금 납부통고서 또는 출석지시서에 운전면허증등의 보관 사실을 기록하여야 한다. <개정 2021.10.19>

② 제1항의 범칙금 납부통고서 또는 출석지시서는 범칙금의 납부기일이나 출석기일까지 운전면허증등(연습운전면허증은 제외한다)과 같은 효력이 있다.

③ 자치경찰공무원이 제1항에 따라 운전면허증등을 보관한 경우에는 지체 없이 관할 경찰서장에게 운전면허증등을 첨부하여 그 사실을 통보하여야 한다.
