대일항쟁기 강제동원 피해조사 및 국외강제동원 희생자 등 지원에 관한 특별법 제3조(유족의 범위 등)

① 이 법에서 "유족"이란 피해자, 국외강제동원 희생자, 미수금피해자 가운데 사망하거나 행방불명된 사람의 친족 중 다음 각 호에 해당하는 사람으로서 제8조제3호 및 제6호에 따라 유족으로 결정을 받은 사람을 말한다.

② 제4조에 따른 위로금 및 제5조에 따른 미수금 지원금을 지급받을 유족의 순위는 제1항 각 호의 순위로 한다.

③ 제1항 각 호의 순위에 따른 유족은 제4조에 따른 위로금 및 제5조에 따른 미수금 지원금을 지급받을 권리를 갖는다. 다만, 같은 순위자가 2명 이상인 경우에는 같은 지분으로 위로금 및 미수금 지원금을 지급받을 권리를 공유한다.

④ 강제동원 피해 사망자의 유골을 인수할 수 있는 유족에 대하여는 제1항 각 호의 해당자가 없는 경우 사망자의 친족 중 제8조에 따른 대일항쟁기강제동원피해조사및국외강제동원희생자등지원위원회가 인정하는 근친 또는 연고자의 순으로 정한다.
