한국환경공단법 제19조(인ㆍ허가등의 의제)
Korea Environment Corporation Act, Article 19 (Deemed Authorizations, Permits, etc.)
① 공단이 제18조에 따라 실시계획의 승인 또는 변경승인을 받은 경우에는 다음 각 호의 허가ㆍ인가ㆍ면허ㆍ승인ㆍ지정 또는 인정(이하 "인ㆍ허가등"이라 한다)에 관하여 기후에너지환경부장관이 관계 행정기관의 장과 미리 협의한 사항에 대해서는 해당 인ㆍ허가등을 받은 것으로 보며, 기후에너지환경부장관이 실시계획의 승인 또는 변경승인의 내용을 고시한 경우에는 다음 각 호의 법률에 따른 인ㆍ허가등의 고시 또는 공고가 있은 것으로 본다. <개정 2010.4.15, 2014.1.14, 2024.1.30, 2025.10.1>
(1) Where the Corporation has obtained approval of an implementation plan or approval of a change thereto under Article 18, the Corporation shall be deemed to have obtained the following permits, authorizations, licenses, approvals, designations or recognitions (hereinafter referred to as "authorizations, permits, etc.") with respect to matters on which the Minister of Climate, Energy and Environment has consulted in advance with the heads of the relevant administrative agencies, and where the Minister of Climate, Energy and Environment has publicly notified the details of the approval of the implementation plan or the approval of the change, a public notice or announcement of the authorizations, permits, etc. under the following Acts shall be deemed made:
1. 「공익사업을 위한 토지 등의 취득 및 보상에 관한 법률」제20조제1항에 따른 사업인정
1. Project approval under Article 20 (1) of the Act on Acquisition of and Compensation for Land, etc. for Public Works Projects;
2. 「국토의 계획 및 이용에 관한 법률」제56조에 따른 개발행위의 허가, 같은 법 제86조에 따른 도시계획시설사업 시행자의 지정 및 같은 법 제88조에 따른 실시계획의 인가
2. Permission for development activities under Article 56 of the National Land Planning and Utilization Act, designation of the implementer of an urban planning facility project under Article 86 of that Act, and authorization of an implementation plan under Article 88 of that Act;
3. 「도로법」제36조에 따른 도로공사시행의 허가와 같은 법 제61조에 따른 도로의 점용허가
3. Permission for road construction under Article 36 of the Road Act and permission for occupation of a road under Article 61 of that Act;
4. Permission for opening a private road under Article 4 of the Private Roads Act;
5. 「공유수면 관리 및 매립에 관한 법률」 제8조에 따른 공유수면의 점용ㆍ사용허가, 같은 법 제17조에 따른 공유수면의 점용ㆍ사용 실시계획의 승인 또는 신고, 같은 법 제28조에 따른 공유수면의 매립면허와 같은 법 제38조에 따른 공유수면매립실시계획의 승인
5. Permission for occupation and use of public waters under Article 8 of the Public Waters Management and Reclamation Act, approval of or report on an implementation plan for occupation and use of public waters under Article 17 of that Act, a license for reclamation of public waters under Article 28 of that Act, and approval of an implementation plan for reclamation of public waters under Article 38 of that Act;

7. 「하천법」 제30조에 따른 하천공사 시행의 허가 및 하천공사실시계획의 인가, 같은 법 제33조에 따른 하천의 점용허가 및 같은 법 제50조에 따른 하천수의 사용허가
7. Permission for river works under Article 30 of the River Act and authorization of a river works implementation plan, permission for occupation of a river under Article 33 of that Act, and permission to use river water under Article 50 of that Act;
8. 「수도법」 제52조에 따른 전용상수도(專用上水道)의 설치 인가와 같은 법 제54조에 따른 전용공업용수도(專用工業用水道)의 설치 인가
8. Authorization for installing a dedicated waterworks under Article 52 of the Water Supply and Waterworks Installation Act and authorization for installing a dedicated industrial waterworks under Article 54 of that Act.
② 제18조제3항 및 이 조 제1항에서 규정한 사항 외에 인ㆍ허가등 의제의 기준 및 효과 등에 관하여는 「행정기본법」 제24조부터 제26조까지를 준용한다. <신설 2024.1.30>
(2) Apart from the matters prescribed in Article 18 (3) and paragraph (1) of this Article, Articles 24 through 26 of the Framework Act on Administration shall apply mutatis mutandis to the standards and effects of deemed authorizations, permits, etc.
