Integrated Energy Supply Business Act, Article 49 (Deemed Authorizations and Permits under Other Acts)
① 제22조제1항에 따라 공사계획을 승인할 때 다음 각 호의 허가ㆍ인가ㆍ승인ㆍ지정ㆍ협의ㆍ신고 또는 면허(이하 이 조에서 "인ㆍ허가등"이라 한다)에 관하여 기후에너지환경부장관이 인ㆍ허가등의 관계 행정기관의 장과 미리 협의한 사항에 대해서는 해당 인ㆍ허가등을 받은 것으로 본다. <개정 2010.4.15, 2011.4.14, 2013.3.23, 2014.1.14, 2016.12.27, 2025.10.1, 2026.3.10>
(1) When approving a construction plan under Article 22 (1), where the Minister of Climate, Energy and Environment has consulted in advance with the heads of the relevant administrative agencies on any of the following permissions, authorizations, approvals, designations, consultations, reports, or licenses (hereinafter in this Article referred to as "authorizations and permits"), the relevant authorizations and permits shall be deemed obtained:
1. 「국토의 계획 및 이용에 관한 법률」 제44조의3제2항에 따른 공동구의 점용 또는 사용의 허가, 같은 법 제56조에 따른 개발행위의 허가, 같은 법 제86조에 따른 도시ㆍ군계획시설사업의 시행자의 지정, 같은 법 제88조에 따른 실시계획의 인가
1. Permission to occupy or use a common utility conduit under Article 44-3 (2) of the National Land Planning and Utilization Act, permission for development activities under Article 56 of that Act, designation of the implementer of an urban or Gun planning facility project under Article 86 of that Act, and authorization of an implementation plan under Article 88 of that Act;
2. 「도로법」 제36조에 따른 도로관리청이 아닌 자에 대한 도로공사 시행의 허가, 같은 법 제61조에 따른 도로의 점용 허가 및 같은 법 제107조에 따른 도로관리청과의 협의 또는 승인
2. Permission for a person other than the road administration authority to carry out road construction under Article 36 of the Road Act, permission to occupy a road under Article 61 of that Act, and consultation or approval with the road administration authority under Article 107 of that Act;
3. Permission to open a private road under Article 4 of the Private Road Act;
4. 「수도법」 제49조에 따른 공업용수도사업의 인가 및 같은 법 제52조제1항에 따른 전용상수도설치의 인가
4. Authorization of an industrial water supply business under Article 49 of the Water Supply and Waterworks Installation Act and authorization for installing a dedicated water supply system under Article 52 (1) of that Act;
5. 「하수도법」 제24조에 따른 공공하수도점용의 허가, 같은 법 제27조에 따른 배수설비 설치의 신고
5. Permission to occupy a public sewerage system under Article 24 of the Sewerage Act and a report on installing drainage facilities under Article 27 of that Act;
6. 「하천법」 제30조제1항에 따른 하천공사시행의 허가, 같은 법 제30조제5항에 따른 하천공사실시계획의 인가 및 같은 법 제33조제1항에 따른 하천구역에서의 점용 또는 행위의 허가
6. Permission to carry out river construction under Article 30 (1) of the River Act, authorization of an implementation plan for river construction under Article 30 (5) of that Act, and permission to occupy or act in a river area under Article 33 (1) of that Act;
7. 「공유수면 관리 및 매립에 관한 법률」 제8조에 따른 공유수면의 점용ㆍ사용허가, 같은 법 제17조에 따른 점용ㆍ사용 실시계획의 승인 또는 신고, 같은 법 제28조에 따른 공유수면의 매립면허 및 같은 법 제38조에 따른 공유수면매립실시계획의 승인
7. Permission to occupy or use public waters under Article 8 of the Public Waters Management and Reclamation Act, approval of or report on an implementation plan for occupation or use under Article 17 of that Act, a reclamation license for public waters under Article 28 of that Act, and approval of an implementation plan for public waters reclamation under Article 38 of that Act;

9. 「자연공원법」 제23조제1항에 따른 공원구역에서의 행위허가
9. Permission for acts in a park area under Article 23 (1) of the Natural Parks Act;
10. 「도시공원 및 녹지 등에 관한 법률」 제24조제1항에 따른 도시공원의 점용허가 및 같은 법 제27조제1항 단서에 따른 도시자연공원구역에서의 행위 허가
10. Permission to occupy an urban park under Article 24 (1) of the Act on Urban Parks and Green Areas, etc. and permission for acts in an urban nature park area under the proviso of Article 27 (1) of that Act;
11. 「농지법」 제34조제1항에 따른 농지전용의 허가
11. Permission for conversion of farmland under Article 34 (1) of the Farmland Act;
12. 「초지법」 제21조의2에 따른 초지 안에서의 행위의 허가
12. Permission for acts in grassland under Article 21-2 of the Grassland Act;
13. 「군사기지 및 군사시설 보호법」 제9조제1항제1호에 따른 통제보호구역 등에의 출입 허가 및 같은 법 제13조에 따른 행정기관의 허가등에 관한 협의
13. Permission to enter a controlled protection zone and the like under Article 9 (1) 1 of the Protection of Military Bases and Installations Act and consultation on permission and the like of administrative agencies under Article 13 of that Act;
14. 「대기환경보전법」 제42조에 따른 연료사용의 승인
14. Approval of fuel use under Article 42 of the Clean Air Conservation Act;
15. 「도시개발법」 제9조제5항에 따른 도시개발구역에서의 행위의 허가
15. Permission for acts in an urban development zone under Article 9 (5) of the Urban Development Act;
16. 「소하천정비법」 제10조에 따른 소하천공사의 허가
16. Permission for small river construction under Article 10 of the Small River Improvement Act;
17. 「농어촌정비법」 제23조에 따른 농업생산기반시설 또는 용수의 사용허가
17. Permission to use agricultural production infrastructure or water under Article 23 of the Agricultural and Fishing Villages Improvement Act;
18. 「폐기물관리법」 제29조제2항에 따른 폐기물처리시설 설치의 승인 또는 신고
18. Approval of or report on installation of waste treatment facilities under Article 29 (2) of the Wastes Control Act.
② 인ㆍ허가등의 관계 행정기관의 장은 제1항에 따른 협의 요청을 받은 날부터 30일 이내에 의견을 제출하여야 한다. 다만, 협의기간에 관하여 다른 법령에 특별한 규정이 있는 경우 그러하지 아니하다. <개정 2026.3.10>
(2) The head of an administrative agency concerned with authorizations and permits shall submit an opinion within 30 days from the date of receiving a request for consultation under paragraph (1): Provided, That this shall not apply where other statutes have special provisions on the consultation period.
③ 제1항 및 제2항에서 규정한 사항 외에 인ㆍ허가등 의제의 기준 및 효과 등에 관하여는 「행정기본법」 제24조부터 제26조까지에 따른다. <신설 2026.3.10>
(3) The standards and effects of deemed authorizations and permits, other than those provided for in paragraphs (1) and (2), shall be governed by Articles 24 through 26 of the Framework Act on Administration.
