지진ㆍ화산재해대책법 시행령 제13조의2(피해시설물 위험도 평가의 절차 및 방법 등)

① 「재난 및 안전관리 기본법」 제16조에 따른 시ㆍ도재난안전대책본부의 본부장 및 시ㆍ군ㆍ구재난안전대책본부의 본부장(이하 "지역대책본부장"이라 한다)은 법 제21조제1항에 따른 피해시설물 위험도 평가(이하 "위험도 평가"라 한다)를 실시하려는 경우에는 지역 상황 등을 고려하여 위험도 평가의 대상ㆍ기간 등을 포함한 위험도 평가 계획을 수립해야 한다.

② 지역대책본부장은 위험도 평가를 실시하기 전에 대상 시설물의 관리자ㆍ소유자 또는 점유자(이하 "관리자등"이라 한다)에게 위험도 평가의 목적ㆍ일시 등을 서면으로 통지해야 한다. 다만, 피해 상황 등을 고려하여 긴급하게 위험도 평가가 필요한 경우에는 구두(口頭)로 통지하거나 사전 통지를 생략할 수 있다.

③ 지역대책본부장은 법 제21조제2항에 따른 피해시설물 위험도 평가단의 현장 조사를 통해 대상 시설물의 사용가능 여부 등을 평가하고, 그 결과를 사용 시 주의사항과 함께 시설물 관리자등에게 알려야 한다.

④ 지역대책본부장은 위험도 평가를 실시한 시설물의 평가 일시 및 결과 등을 기록ㆍ관리해야 한다.

⑤ 제1항부터 제4항까지에서 규정한 사항 외에 위험도 평가의 절차ㆍ방법 등에 필요한 사항은 행정안전부장관이 시ㆍ도지사등의 의견을 들어 지침을 마련하고 시ㆍ도지사등에게 통보해야 한다.
