Act on Coexistence and Revitalization of Local Commercial Districts, Article 31 (Restrictions on Types of Business)

① 시장ㆍ군수ㆍ구청장은 지역상생구역의 상생발전을 위하여 지역상생구역 내에서 다음 각 호의 어느 하나에 해당하는 영업 또는 시설의 설치를 금지하거나 제한할 수 있다.

1. 「사행행위 등 규제 및 처벌 특례법」에 따른 사행행위영업

5. 그 밖에 지역상생구역의 지정 목적을 해칠 우려가 있는 시설로서 해당 지방자치단체의 조례로 정하는 것

② 시장ㆍ군수ㆍ구청장은 제1항에 따라 영업 또는 시설의 설치를 금지하거나 제한하려는 경우 금지ㆍ제한되는 영업 또는 시설에 관한 사항을 대통령령으로 정하는 바에 따라 지역상생협의체의 협의 및 지역상권위원회의 심의를 거쳐 미리 공고해야 한다.

③ 지역상생구역 내에서 제1항 및 제2항에 따라 금지ㆍ제한하는 것으로 공고된 영업을 하려는 자는 영업을 하기 전에 대통령령이 정하는 바에 따라 지역상생협의체와 사전사업조정에 대한 협의 및 지역상권위원회의 심의를 거쳐 시장ㆍ군수ㆍ구청장에게 등록하여야 한다. 다만, 제1항제4호에 해당하는 자가 「유통산업발전법」 제8조에 따른 등록을 마친 경우에는 이 법에 따른 사전사업조정에 대한 협의 결과를 등록한 것으로 간주한다.
