위생용품 관리법 제4조(휴업ㆍ폐업 및 재개업의 신고 등)

① 제3조에 따른 신고를 한 자(이하 "영업자"라 한다)가 휴업ㆍ폐업하거나 영업을 재개하려는 경우에는 식품의약품안전처장 또는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장에게 신고하여야 한다.

② 제1항에도 불구하고 제15조부터 제19조까지의 규정에 따른 영업정지 등 행정 제재처분을 받은 자는 그 기간 중에는 폐업신고를 할 수 없다.

③ 식품의약품안전처장 또는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제1항에 따른 신고가 신고서 및 첨부서류에 흠이 없고 형식적 요건을 충족하면 지체 없이 접수하여야 한다.

④ 식품의약품안전처장 또는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 영업자가 「부가가치세법」 제8조에 따라 관할 세무서장에게 폐업신고를 하거나 관할 세무서장이 사업자등록을 말소한 경우에는 신고 사항을 직권으로 말소할 수 있다.

⑤ 식품의약품안전처장 또는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제4항에 따른 직권말소를 위하여 필요한 경우 관할 세무서장에게 영업자의 폐업 여부에 대한 정보 제공을 요청할 수 있다. 이 경우 식품의약품안전처장 또는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 폐업 여부를 확인하기 위하여 필요하면 「전자정부법」 제36조제1항에 따라 행정정보를 공동이용할 수 있다.

⑥ 제1항에 따른 신고의 내용, 방법 및 절차 등에 필요한 사항은 총리령으로 정한다.
