습지보전법 시행령 제18조(권한ㆍ사무의 위임ㆍ위탁)
Enforcement Decree of the Wetlands Conservation Act, Article 18 (Delegation and Entrustment of Authority and Affairs)
①기후에너지환경부장관은 법 제21조제1항에 따라 유역환경청장 또는 지방환경청장(이하 "지방환경관서의 장"이라 한다)에게 내륙습지와 관련된 다음 각 호의 권한을 위임한다. <개정 2007.7.24, 2025.10.1>
(1) Under Article 21 (1) of the Act, the Minister of Climate, Energy and Environment delegates the following authority relating to inland wetlands to the heads of River Basin Environmental Offices or Regional Environmental Offices (hereinafter referred to as the "heads of regional environmental offices"):
1. 법 제11조의 규정에 의한 습지보호지역등에 대한 보전계획의 수립ㆍ시행
1. Formulation and implementation of conservation plans for wetland protected areas, etc. under Article 11 of the Act;
2. 법 제12조제1항에 따른 습지보전ㆍ이용시설의 설치
2. Installation of wetland conservation and use facilities under Article 12 (1) of the Act;
3. 법 제12조제2항에 따른 습지보전ㆍ이용시설 설치의 승인
3. Approval of installation of wetland conservation and use facilities under Article 12 (2) of the Act;
4. 법 제13조제3항 또는 제5항의 규정에 의한 승인 또는 협의
4. Approval or consultation under Article 13 (3) or (5) of the Act;
5. 법 제14조의 규정에 의한 습지보호지역에서의 행위중지명령, 원상회복명령 및 이에 상응한 조치의 명령
5. Orders to suspend acts, orders to restore to the original state, and orders for measures corresponding thereto in wetland protected areas under Article 14 of the Act;
6. 법 제15조의 규정에 의한 출입의 제한ㆍ금지, 출입의 제한ㆍ금지의 해제 및 그 고시
6. Restriction or prohibition of entry, release of restriction or prohibition of entry, and public notification thereof under Article 15 of the Act;
7. 법 제18조의2제1항 및 제2항의 규정에 의한 이용료의 징수
7. Collection of usage fees under Article 18-2 (1) and (2) of the Act;
8. 법 제19조의 규정에 의한 포상금의 지급
8. Payment of rewards under Article 19 of the Act;
9. 법 제22조의3의 규정에 의한 명예습지생태안내인의 위촉ㆍ관리
9. Commissioning and management of honorary wetland ecology guides under Article 22-3 of the Act;
10. 법 제27조제1항제1호의 규정에 의한 과태료의 부과ㆍ징수
10. Imposition and collection of administrative fines under Article 27 (1) 1 of the Act;
11. 제13조의 규정에 의한 습지보호지역 및 습지개선지역에서의 금지행위의 예외사항에 대한 협의
11. Consultation on exceptions to prohibited acts in wetland protected areas and wetland improvement areas under Article 13.
② 기후에너지환경부장관은 법 제21조제1항에 따라 시장ㆍ군수ㆍ구청장(제2호의 경우 토지등이 둘 이상의 시ㆍ군 또는 자치구에 걸쳐 있는 경우에는 그 토지등의 가장 넓은 부분이 속하는 지역을 관할하는 시장ㆍ군수ㆍ구청장을 말한다)에게 내륙습지와 관련된 다음 각 호의 권한을 위임한다. <개정 2021.7.6, 2025.10.1>
(2) Under Article 21 (1) of the Act, the Minister of Climate, Energy and Environment delegates the following authority relating to inland wetlands to the head of a Si/Gun/Gu (in the case of subparagraph 2, where land, etc. spans two or more Sis/Guns or autonomous Gus, the head of the Si/Gun/Gu having jurisdiction over the area to which the largest part of the land, etc. belongs):
1. 법 제18조의2제1항 및 제2항에 따른 이용료의 징수에 관한 권한
1. Authority concerning collection of usage fees under Article 18-2 (1) and (2) of the Act;
2. 법 제20조의2에 따른 토지등의 매수에 관한 권한
2. Authority concerning purchase of land, etc. under Article 20-2 of the Act.
③해양수산부장관은 법 제21조제1항에 따라 지방해양수산청장에게 연안습지와 관련된 다음 각 호의 권한을 위임한다. <개정 2007.7.24, 2008.2.29, 2013.3.23, 2015.1.6>
(3) Under Article 21 (1) of the Act, the Minister of Oceans and Fisheries delegates the following authority relating to coastal wetlands to the heads of Regional Offices of Oceans and Fisheries:
1. 법 제11조의 규정에 의한 습지보호지역등에 대한 보전계획의 수립ㆍ시행
1. Formulation and implementation of conservation plans for wetland protected areas, etc. under Article 11 of the Act;
2. 법 제12조제1항에 따른 습지보전ㆍ이용시설의 설치
2. Installation of wetland conservation and use facilities under Article 12 (1) of the Act;
3. 법 제22조의3의 규정에 의한 명예습지생태안내인의 위촉ㆍ관리
3. Commissioning and management of honorary wetland ecology guides under Article 22-3 of the Act.
④해양수산부장관은 법 제21조제1항에 따라 시장ㆍ군수ㆍ구청장에게 연안습지와 관련된 다음 각 호의 권한을 위임한다. 이 경우 둘 이상의 시ㆍ군 또는 자치구에 걸쳐 있는 토지등에 대한 제5호의 권한은 그 토지등의 가장 넓은 부분이 속하는 지역을 관할하는 시장ㆍ군수ㆍ구청장에게 위임한다. <개정 2008.2.29, 2013.3.23, 2019.10.29>
(4) Under Article 21 (1) of the Act, the Minister of Oceans and Fisheries delegates the following authority relating to coastal wetlands to the head of a Si/Gun/Gu. In this case, the authority under subparagraph 5 concerning land, etc. spanning two or more Sis/Guns or autonomous Gus shall be delegated to the head of the Si/Gun/Gu having jurisdiction over the area to which the largest part of the land, etc. belongs:
1. 법 제14조의 규정에 의한 습지보호지역에서의 행위중지명령, 원상회복명령 및 이에 상응한 조치의 명령
1. Orders to suspend acts, orders to restore to the original state, and orders for measures corresponding thereto in wetland protected areas under Article 14 of the Act;
2. 법 제15조의 규정에 의한 출입의 제한ㆍ금지, 출입의 제한ㆍ금지의 해제 및 그 고시
2. Restriction or prohibition of entry, release of restriction or prohibition of entry, and public notification thereof under Article 15 of the Act;
3. 법 제18조의2제1항 및 제2항의 규정에 의한 이용료의 징수
3. Collection of usage fees under Article 18-2 (1) and (2) of the Act;

⑤ 기후에너지환경부장관과 해양수산부장관은 법 제21조제2항에 따라 다음 각 호의 업무를 「국립생태원의 설립 및 운영에 관한 법률」에 따른 국립생태원(이하 "국립생태원"이라 한다)과 「해양환경관리법」 제96조에 따른 해양환경공단에 각각 위탁한다. <신설 2019.10.29, 2021.7.6, 2025.10.1>
(5) Under Article 21 (2) of the Act, the Minister of Climate, Energy and Environment and the Minister of Oceans and Fisheries entrust the following affairs to the National Institute of Ecology under the Act on the Establishment and Operation of the National Institute of Ecology (hereinafter referred to as the "National Institute of Ecology") and the Korea Marine Environment Management Corporation under Article 96 of the Marine Environment Management Act, respectively:
1. 법 제4조에 따른 기초조사, 정밀조사 및 보완조사
1. Basic surveys, detailed surveys, and supplementary surveys under Article 4 of the Act;
2. 법 제9조제3항에 따른 다른 협약 가입국과의 공동연구 및 자료 교환 등에 관한 사무
2. Affairs concerning joint research and exchange of data with other contracting states to the convention under Article 9 (3) of the Act;
3. 법 제17조제2항에 따른 습지의 생태계 변화 상황 관찰 및 보전에 관한 사무
3. Affairs concerning observation of changes in the wetland ecosystem and conservation under Article 17 (2) of the Act.
