산지관리법 제37조(재해의 방지 등)

① 산림청장등은 다음 각 호의 어느 하나에 해당하는 허가 등과 제15조의2제10항 또는 제25조의2제1항에 따라 산지전용, 산지일시사용, 토석채취 또는 복구를 하고 있는 산지에 대하여 대통령령으로 정하는 바에 따라 토사유출, 산사태 또는 인근지역의 피해 등 재해 방지나 산지경관 유지 등에 필요한 조사ㆍ점검ㆍ검사 등을 할 수 있다. <개정 2012.2.22, 2018.3.20, 2026.9.22>

② 제1항에도 불구하고 「재생에너지 개발ㆍ이용ㆍ보급 촉진법」에 따른 재생에너지 설비, 「수소경제 육성 및 수소 안전관리에 관한 법률」에 따른 수소에너지 설비 또는 연료전지등을 설치하기 위하여 제1항제1호 및 제3호(다른 법률에 따라 산지전용허가 또는 산지일시사용허가가 의제되거나 배제되는 행정처분을 포함한다)에 해당하는 허가를 받은 자는 대통령령으로 정하는 조사절차 및 방법에 따라 대통령령으로 정하는 점검기관에 의뢰하여 조사ㆍ점검ㆍ검사 등을 정기적으로 실시한 후 그 결과를 산림청장등에게 제출하여야 한다. 이 경우 산림청장은 관계 행정기관의 장에게 재생에너지 설비, 수소에너지 설비 또는 연료전지등의 설치를 위하여 조사ㆍ점검ㆍ검사 등에 필요한 자료의 제출 또는 협조를 요청할 수 있으며, 요청을 받은 관계 행정기관의 장은 특별한 사유가 없으면 요청에 따라야 한다. <신설 2019.12.3, 2020.2.18, 2026.3.17>

③ 산림청장등은 제2항에 따라 제출된 결과를 활용하여 산지태양광발전설비에 대한 현황, 산림훼손 실태, 재해방지 조치 및 산지복구 대책을 내용으로 하는 산지태양광발전설비 관리계획을 매년 1월 말까지 수립ㆍ시행하여야 한다. <신설 2020.2.18, 2021.6.15>

⑦ 산림청장등은 제1항 및 제2항에 따른 조사ㆍ점검ㆍ검사 등을 한 결과에 따라 필요하다고 인정하면 대통령령으로 정하는 바에 따라 제1항 각 호의 어느 하나에 해당하는 허가 등의 처분을 받거나 신고 등을 한 자 및 제15조의2제10항 또는 제25조의2제1항에 따라 허가ㆍ신고 없이 할 수 있는 행위를 한 자에게 다음 각 호 중 필요한 조치를 하도록 명령할 수 있다. 다만, 제1항제1호 또는 제8호에 따른 허가 또는 처분을 받은 자로서 「광업법」에 따라 광물의 채굴을 하는 자는 「광산안전법」에 따르고, 「국토의 계획 및 이용에 관한 법률」에 따라 도시지역 및 계획관리지역에서의 인가ㆍ허가 및 승인 등의 행정처분을 받은 자는 「국토의 계획 및 이용에 관한 법률」에 따른다. <개정 2012.2.22, 2016.1.6, 2018.3.20, 2019.12.3, 2020.2.18, 2021.6.15, 2026.9.22>

⑨ 산림청장등은 제8항제1호에 따라 토사유출의 방지조치, 산사태 또는 인근 지역의 피해 등 재해의 방지나 산지경관 유지에 필요한 조치 또는 복구를 대행하게 하고 그 비용을 예치된 복구비로 충당한 경우 그 비용충당으로 줄어든 복구비 예치금을 대통령령으로 정하는 바에 따라 다시 예치하게 하여야 한다. <개정 2012.2.22, 2018.3.20, 2019.12.3, 2020.2.18, 2021.6.15, 2026.9.22>
