Enforcement Decree of the Act on the Control of Narcotics, etc., Article 28 (Delegation of Authority)
① 식품의약품안전처장은 법 제56조에 따라 법 제52조의2에 따른 임시마약류 등의 유해성 평가에 관한 권한을 식품의약품안전평가원장에게 위임한다. <신설 2019.3.12>
(1) Pursuant to Article 56 of the Act, the Minister of Food and Drug Safety delegates the authority concerning the hazard assessment of temporary narcotics, etc. under Article 52-2 of the Act to the Director of the National Institute of Food and Drug Safety Evaluation.
② 식품의약품안전처장은 법 제56조에 따라 다음 각 호의 권한을 지방식품의약품안전청장에게 위임한다. <개정 2013.3.23, 2016.11.1, 2019.3.12, 2021.12.14, 2024.1.30>
(2) Pursuant to Article 56 of the Act, the Minister of Food and Drug Safety delegates the following authority to the head of a regional food and drug safety office:
1. 법 제6조제1항제4호에 따른 마약류취급학술연구자의 허가 및 변경허가
1. Permission and permission for change for narcotics handling academic researchers under Article 6 (1) 4 of the Act;
1의2. 법 제6조의2제1항에 따른 원료물질의 수출입업 또는 제조업의 허가 및 변경허가
1-2. Permission and permission for change for the export, import, or manufacture of precursor chemicals under Article 6-2 (1) of the Act;
1의3. 법 제7조제1항 및 제2항에 따른 마약류취급학술연구자 및 원료물질수출입업자등의 명부(名簿) 기록 및 허가증 또는 지정서 발급 및 재발급
1-3. Recording in the register of narcotics handling academic researchers and precursor chemical importers/exporters, etc. and issuance and reissuance of permits or certificates of designation under Article 7 (1) and (2) of the Act;
2. 법 제8조에 따른 마약류취급학술연구자 또는 원료물질수출입업자등의 마약류 또는 원료물질 취급에 관한 업무의 폐업 등의 신고의 수리(受理)
2. Acceptance of reports of closure of business, etc. concerning the handling of narcotics or precursor chemicals by narcotics handling academic researchers or precursor chemical importers/exporters, etc. under Article 8 of the Act;
3. 법 제9조제2항제1호 및 같은 조 제3항에 따른 마약류 양도의 승인
3. Approval of transfer of narcotics under Article 9 (2) 1 and paragraph (3) of that Article of the Act;
4. 법 제12조에 따른 사고 마약류의 처리 및 이에 대한 보고의 접수
4. Handling of accident narcotics under Article 12 of the Act and acceptance of reports thereon;
5. 법 제13조제1항에 따른 마약류취급학술연구자의 자격 상실 등에 따른 소지 중인 마약류의 처분 승인
5. Approval of disposition of narcotics in possession upon loss of qualifications of a narcotics handling academic researcher under Article 13 (1) of the Act;
6. 법 제16조제2항 단서에 따른 마약류취급학술연구자에 대한 무봉함(無封緘) 마약 및 향정신성의약품 수수의 승인
6. Approval of delivery and receipt of unsealed narcotic drugs and psychotropic drugs to narcotics handling academic researchers under the proviso of Article 16 (2) of the Act;
7. 법 제35조제2항에 따른 마약류취급학술연구자의 대마의 학술연구용 사용 보고와 대마초 재배 보고의 접수
7. Acceptance of reports on use of cannabis for academic research and reports on cannabis plant cultivation by narcotics handling academic researchers under Article 35 (2) of the Act;

9. 법 제42조에 따른 마약류의 폐기 명령 및 폐기 처분
9. Orders for disposal of narcotics and disposal of narcotics under Article 42 of the Act;

11. 법 제44조제1항에 따른 마약류취급학술연구자 또는 원료물질수출입업자등에 대한 허가의 취소와 그 업무 또는 마약류 사용의 전부나 일부의 정지명령 및 법 제46조에 따른 마약류취급학술연구자 또는 원료물질수출입업자등에 대한 과징금의 부과ㆍ징수
11. Revocation of permission for narcotics handling academic researchers or precursor chemical importers/exporters, etc. under Article 44 (1) of the Act, orders to suspend all or part of their business or use of narcotics, and imposition and collection of penalty surcharges against narcotics handling academic researchers or precursor chemical importers/exporters, etc. under Article 46 of the Act;
12. 법 제47조에 따른 부정 마약의 처분
12. Disposition of illegal narcotic drugs under Article 47 of the Act;
13. 법 제51조의5 및 이 영 제20조의6에 따른 마약류 명예지도원의 위촉ㆍ위촉해제 및 그 운영
13. Commissioning, rescinding the commission of, and operating honorary narcotics guidance officers under Article 51-5 of the Act and Article 20-6 of this Decree;
14. 법 제50조에 따른 마약류수출입업자ㆍ마약류제조업자ㆍ마약류원료사용자ㆍ마약류취급학술연구자 및 원료물질수출입업자등에 대한 교육 및 수료증 발급
14. Education of narcotics importers/exporters, narcotics manufacturers, narcotics raw material users, narcotics handling academic researchers, and precursor chemical importers/exporters, etc., and issuance of certificates of completion under Article 50 of the Act;
14의2. 법 제51조제3항에 따른 신고의 접수
14-2. Acceptance of reports under Article 51 (3) of the Act;
15. 법 제69조에 따른 마약류취급학술연구자 또는 원료물질수출입업자등에 대한 과태료의 부과ㆍ징수
15. Imposition and collection of administrative fines against narcotics handling academic researchers or precursor chemical importers/exporters, etc. under Article 69 of the Act.
