마약류 관리에 관한 법률 제12조(사고 마약류 등의 처리)
Act on the Control of Narcotics, etc., Article 12 (Handling of Narcotics Involved in Accidents, etc.)
① 마약류취급자 또는 마약류취급승인자는 소지하고 있는 마약류에 대하여 다음 각 호의 어느 하나에 해당하는 사유가 발생하면 총리령으로 정하는 바에 따라 해당 허가관청(마약류취급의료업자의 경우에는 해당 의료기관의 개설허가나 신고관청을 말하며, 마약류소매업자의 경우에는 약국 개설 등록관청을 말한다. 이하 같다)에 지체 없이 그 사유를 보고하여야 한다. <개정 2013.3.23, 2016.2.3>
(1) Where any of the following occurs with respect to narcotics in the possession of a narcotics handler or an approved narcotics handling person, he or she shall report it without delay to the relevant permitting authority (meaning, for a narcotics handling medical practitioner, the authority that granted permission for or received the report of the establishment of the medical institution, and, for a narcotics retailer, the authority with which the pharmacy is registered; the same applies hereinafter), as prescribed by Ordinance of the Prime Minister:
1. 재해로 인한 상실(喪失)
1. Loss due to a disaster;
2. 분실 또는 도난
2. Loss or theft;
3. 변질ㆍ부패 또는 파손
3. Deterioration, decay or damage.
② 마약류취급자 또는 마약류취급승인자가 소지하고 있는 마약류를 다음 각 호의 어느 하나에 해당하는 사유로 폐기하려는 경우에는 총리령으로 정하는 바에 따라 폐기하여야 한다. <개정 2013.3.23, 2016.2.3>
(2) Where a narcotics handler or an approved narcotics handling person intends to dispose of narcotics in his or her possession for any of the following reasons, he or she shall dispose of them as prescribed by Ordinance of the Prime Minister:
1. 제1항제3호에 해당하는 사유
1. A reason under paragraph (1) 3;
2. 유효기한 또는 사용기한의 경과
2. Expiry of the expiration date or use-by date;
3. 유효기한 또는 사용기한이 지나지 아니하였으나 재고관리 또는 보관을 하기에 곤란한 사유
3. A reason that makes inventory management or storage difficult even though the expiration date or use-by date has not passed.
