농수산물 품질관리법 제78조(생산ㆍ가공의 중지 등)

Agricultural and Fishery Products Quality Control Act, Article 78 (Suspension of Production and Processing)

① 해양수산부장관은 생산ㆍ가공시설등이나 생산ㆍ가공업자등이 다음 각 호의 어느 하나에 해당하면 대통령령으로 정하는 바에 따라 생산ㆍ가공ㆍ출하ㆍ운반의 시정ㆍ제한ㆍ중지 명령, 생산ㆍ가공시설등의 개선ㆍ보수 명령 또는 등록취소를 할 수 있다. 다만, 제1호에 해당하면 그 등록을 취소하여야 한다. <개정 2013.3.23, 2019.1.15>

1. 거짓이나 그 밖의 부정한 방법으로 제74조에 따른 등록을 한 경우

② 해양수산부장관은 제1항에 따른 등록취소를 위하여 필요한 경우 관할 세무서장에게 생산ㆍ가공업자등의 폐업 또는 사업자등록 말소 여부에 대한 정보 제공을 요청할 수 있다. 이 경우 요청을 받은 관할 세무서장은 「전자정부법」 제36조제1항에 따라 생산ㆍ가공업자등의 폐업 또는 사업자등록 말소 여부에 대한 정보를 제공하여야 한다. <신설 2019.1.15>
