국민연금법 시행규칙 제6조(사업장가입자의 자격 취득ㆍ상실의 신고)

①사용자는 해당 사업장의 근로자나 사용자 본인이 법 제11조제1항에 따라 사업장가입자의 자격을 취득하거나 법 제12조제1항에 따라 사업장가입자의 자격을 상실하면 그 사유가 발생한 날이 속하는 달의 다음 달 15일까지 다음 각 호의 구분에 따른 서류를 공단에 제출하여야 한다. <개정 2011.12.8>

② 법 제8조제2항 단서 및 제3항에 따라 사업장가입자가 되지 않기를 희망하는 18세 미만 근로자 및「국민기초생활 보장법」 제7조제1항제1호에 따른 생계급여 수급자 또는 같은 항 제3호에 따른 의료급여 수급자인 근로자는 별지 제7호의2서식의 사업장가입자 적용제외 신청서를 공단에 제출하여야 하고, 사업장가입자의 자격을 상실한 18세 미만 근로자 및「국민기초생활 보장법」 제7조제1항제1호에 따른 생계급여 수급자 또는 같은 항 제3호에 따른 의료급여 수급자인 근로자가 다시 사업장가입자의 자격을 취득하려는 경우에는 별지 제7호의2서식의 사업장가입자 재가입 신청서를 공단에 제출하여야 한다. <신설 2011.12.8, 2015.7.1, 2016.2.4>

③ 제2항의 경우 공단은 「전자정부법」 제36조제2항에 따른 행정정보의 공동이용을 통하여 「국민기초생활 보장법」에 따른 생계급여 수급자 또는 의료급여 수급자임을 증명하는 서류를 확인하여야 하며, 신청인이 확인에 동의하지 아니하는 경우에는 그 사본을 첨부하도록 하여야 한다. <신설 2011.12.8, 2016.2.4>

④ 영 제2조제4호다목에 따라 근로자로 적용되기를 희망하는 사람(이하 이 조에서 "복수사업장 단시간근로자"라 한다)은 별지 제7호의3서식의 복수사업장 단시간근로자 사업장가입자자격 취득 신청서를 공단에 제출하여야 하고, 사업장가입자의 자격을 취득한 복수사업장 단시간근로자가 사업장가입자의 자격을 상실하려면 별지 제7호의3서식의 복수사업장 단시간근로자 사업장가입자자격 상실 신청서를 공단에 제출하여야 한다. <신설 2015.7.1>
