Enforcement Decree of the Act on Honorable Treatment and Support for Persons of Distinguished Service to the State, Article 64-2 (Bearing of Drug Costs)

① 국가는 법 제42조제1항ㆍ제2항ㆍ제5항ㆍ제7항 또는 법 제42조의2에 따라 국가유공자와 그 유족 및 가족이 다음 각 호의 구분에 따라 진료를 받고 해당 의사 또는 치과의사가 발행한 처방전으로 「약사법」 제20조에 따라 등록된 약국에서 의약품을 조제받는 경우에는 해당 호에서 정하는 바에 따라 그 약제비용(「국민건강보험법 시행령」 별표 2 제1호다목에 따른 비용을 말한다. 이하 이 조에서 같다)을 부담하거나 지급한다. <개정 2022.5.9, 2023.5.23, 2023.9.26, 2026.6.9>

1. 진료대상자가 법 제42조제1항 또는 제2항에 따른 의료기관 및 위탁병원에서 진료받은 경우: 전액 부담. 다만, 상이등급이 7급인 진료대상자가 그 상이처 외의 질병에 걸려 진료를 받는 경우에는 제63조의2제2항 본문에 따른 본인 부담분은 제외한다.

나. 법 제42조제7항 각 호 외의 부분 전단에 따른 의료기관(법 제42조제7항제1호 또는 제2호에 해당하는 사람으로 한정한다): 국가보훈부장관이 정하여 고시하는 1인당 연간 지급 금액의 한도에서 감면비율에 따른 금액을 지급. 다만, 「국민건강보험법 시행령」 별표 2 제6호에 따라 요양급여비용을 부담하게 되는 경우에는 약제비용을 지급하지 않는다.

② 제1항에 따라 국가가 부담하는 비용은 「한국보훈복지의료공단법」에 따른 한국보훈복지의료공단(이하 "한국보훈복지의료공단"이라 한다)의 예산에 계상(計上)하여 지급한다. <개정 2021.10.19>
