공직자 등의 병역사항 신고 및 공개에 관한 법률 제4조(신고시기와 신고기관등)

① 신고의무자는 신고의무자가 된 날부터 1개월 이내에 신고의무자가 된 날 현재의 신고대상자의 병역사항을 적은 병역사항 신고서를 대통령령으로 정하는 신고의무자의 소속 기관(이하 "신고기관"이라 한다)에 제출(「정보통신망 이용촉진 및 정보보호 등에 관한 법률」에 따른 정보통신망을 이용하여 제출하는 경우를 포함한다. 이하 같다)하여야 한다. 다만, 신고의무자가 부득이한 사유로 병역사항 신고기간의 연장을 신청한 경우에 그 사유가 타당하다고 신고기관의 장이 인정할 때에는 1개월의 범위에서 신고일을 정하여 신고기간을 연장할 수 있다. <개정 2007.12.14>

③ 제1항에 따른 신고 및 제5조제1항에 따른 변동사항의 신고를 받은 신고기관의 장은 신고를 받은 날부터 1개월 이내에 그 신고내용을 대통령령으로 정하는 바에 따라 병무청장이나 지방병무청장(병무지청장을 포함한다. 이하 같다)에게 통보(「정보통신망 이용촉진 및 정보보호 등에 관한 법률」에 따른 정보통신망을 이용하여 통보하는 경우를 포함한다. 이하 같다)하여야 한다. 다만, 퇴직 등의 사유로 신고의무자로서의 지위를 상실한 사람과 제8조의2제1항에 따라 병역사항의 공개가 보류된 사람(이하 "병역사항 공개보류자"라 한다)의 경우에는 그러하지 아니하다. <개정 2007.12.14>

④ 신고기관의 장은 신고대상자의 확인과 관련하여 필요한 경우 신고의무자의 동의를 받아 법원행정처장에게 「가족관계의 등록 등에 관한 법률」 제11조에 따른 등록전산정보자료의 제공을 요청할 수 있다. 이 경우 요청을 받은 법원행정처장은 특별한 사유가 없으면 이에 따라야 한다. <신설 2022.12.13>
