Enforcement Decree of the Special Act on the Establishment and Operation of Foreign Educational Institutions in Free Economic Zones and the Jeju Free International City, Article 2 (Establishment Standards for Facilities and Equipment of Foreign Educational Institutions)

①「경제자유구역 및 제주국제자유도시의 외국교육기관 설립ㆍ운영에 관한 특별법」(이하 "법"이라 한다) 제5조제1항의 규정에 의한 외국교육기관의 시설ㆍ설비 등 설립기준 중 「유아교육법」에 따른 유치원 및 「초ㆍ중등교육법」에 따른 학교에 상응하는 외국교육기관의 설립기준은 다음 각 호와 같다. <개정 2011.3.9>

4. 「고등학교 이하 각급 학교 설립ㆍ운영 규정」 제13조제1항의 규정에 의한 연간 학교회계 운영수익총액의 2분의 1이상에 해당하는 가액의 수익용기본재산의 확보 또는 그 가액을 보험금으로 하는 보증보험에의 가입

②법 제5조제1항에 따른 외국교육기관의 시설ㆍ설비 등 설립기준 중 「고등교육법」 제2조에 따른 학교(같은 법 제30조에 따른 대학원대학을 포함한다. 이하 같다)에 상응하는 외국교육기관의 설립기준은 다음 각 호와 같다. <개정 2008.10.24, 2011.3.9, 2023.9.19>

③ 외국학교법인이 외국의 법령 등을 고려하여 교육부장관이 정하여 고시하는 설립기준에 따라 자국(自國)에 설립한 학교와 같은 수준의 기준을 갖추어 외국교육기관을 설립하는 경우에는 제1항제1호부터 제3호까지 및 제2항제1호부터 제3호까지의 규정에도 불구하고 각 해당 호의 설립기준을 충족한 것으로 본다. <신설 2011.3.9, 2013.3.23>

④외국교육기관의 학급ㆍ학과 또는 학부를 증설하거나 학생정원을 증원하고자 하는 경우에는 그 증설 또는 증원분을 포함한 전체에 대하여 이 영에 의한 기준을 갖추어야 한다. <개정 2011.3.9>
