한부모가족지원법 시행령 제12조(복지 급여의 신청 및 지급 절차 등)

① 법 제11조제1항에 따라 법 제12조의 복지 급여를 신청할 수 있는 이해관계인은 다음 각 호의 어느 하나에 해당하는 사람을 말한다. <개정 2014.7.21, 2025.5.27>

② 법 제12조에 따른 복지 급여를 신청하려는 사람은 성평등가족부령으로 정하는 복지 급여 신청서(전자문서로 된 신청서를 포함한다)에 지원대상자의 다음 각 호의 서류(전자문서를 포함한다)를 첨부하여 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장(자치구의 구청장을 말한다. 이하 같다)에게 제출하여야 한다. <개정 2014.7.21, 2025.10.1>

③ 제2항에 따른 신청을 받은 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 지원대상자의 가족관계기록사항에 관한 증명서의 내용을 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 확인하여야 한다. 다만, 지원대상자가 확인에 동의하지 아니하면 해당 서류를 첨부하도록 하여야 한다. <개정 2014.7.21>

④ 제2항에 따른 신청을 받은 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 신청을 받은 날부터 30일 이내에 복지 급여 제공 여부를 결정하여 신청인에게 통지하여야 한다. <개정 2014.7.21, 2018.5.29>

⑤ 제4항에 따라 결정된 복지 급여는 급여 신청일이 포함된 달부터 지급한다.
