증권관련 집단소송법 제44조(분배에서 제외하는 비용 등)

① 분배관리인은 권리실행으로 취득한 금액에서 다음 각 호의 비용을 공제할 수 있다.

② 분배관리인은 제46조제1항에 따른 분배계획안의 인가를 받기 전에 제1항제1호부터 제3호까지의 비용을 지급하려면 법원의 허가를 받아야 한다.

(2) The^ð더 distribution디스트^r러뷰션 administrator어드미너스트^r레이터 shall섈 obtain어브테인 the^ð더 court's코츠 permission퍼미션 to투 pay페이 the^ð디 expenses익스펜시즈 in인 subparagraphs서브패^r러그^r래^f프스 1 through^θ쓰^r루 3 of어^v브 paragraph패^r러그^r래^f프 (1) before비^f포 obtaining어브테이닝 approval어프^r루^v블 of어^v브 the^ð더 draft드^r래^f프트 distribution디스트^r러뷰션 plan플랜 under언더 Article아터클 46 (1).

③ 법원은 분배관리인, 대표당사자 또는 구성원이 신청한 경우에는 소송의 진행과정 및 결과 등 여러 사정을 고려하여 제1항제1호의 변호사 보수를 감액할 수 있다. 이 경우 법원은 신청인과 대표당사자의 소송대리인을 심문하여야 한다.

④ 제3항의 신청은 제46조제1항에 따른 분배계획안의 인가 전까지 하여야 한다.

⑤ 제3항에 따른 결정에 대하여는 즉시항고를 할 수 있다.
