아동복지법 제16조의3(보호기간의 연장)

① 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 연령이 18세에 달한 보호대상아동이 보호조치를 연장할 의사가 있는 경우에는 제16조제1항에도 불구하고 그 보호기간을 해당 아동이 25세에 달할 때까지로 연장하여야 한다.

② 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 제1항에 따라 보호기간이 연장된 사람이 보호조치의 종료를 요청하는 경우 그 보호조치를 종료하여야 한다. 다만, 자립 능력이 부족하여 보호기간의 연장이 필요한 경우로서 대통령령으로 정하는 경우에는 심의위원회의 심의를 거쳐 종료하지 아니할 수 있다.

③ 제1항에도 불구하고 같은 항에 따라 보호기간이 연장된 사람이 다음 각 호의 어느 하나에 해당하면 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 그 보호기간을 추가로 연장할 수 있다.
