산지관리법 제44조의2(불법전용산지 등의 조사)

① 산림청장등은 다음 각 호의 사항을 조사하기 위하여 산지전용허가ㆍ산지일시사용허가를 받았거나 산지전용신고ㆍ산지일시사용신고를 한 자, 토석채취허가를 받았거나 토석채취신고 또는 채석신고를 한 자에게 업무에 관한 사항을 보고하게 하거나 관련 자료의 제출 및 현지조사를 요구할 수 있으며, 관계 공무원에게 그 허가를 받았거나 신고를 한 자의 사업장, 해당 산지, 그 밖의 필요한 장소에 출입하여 장부ㆍ서류나 그 밖의 물건을 검사하게 하거나 관계인에게 질문하게 할 수 있다. <개정 2012.2.22, 2016.12.2>

② 산림청장등은 제1항 각 호에 대하여 전국적인 일제조사가 필요하다고 인정하는 경우에는 기간을 정하여 대통령령으로 정하는 산지전문기관에게 이를 대행하게 하거나 위탁할 수 있다. <개정 2012.2.22>

③ 산림청장등은 제1항ㆍ제2항에 따른 조사 결과에 따라 제20조, 제31조 및 제44조 등의 필요한 조치를 할 수 있다. <개정 2012.2.22>
