Mountainous Districts Management Act, Article 20 (Cancellation, etc. of Permission for Conversion of Mountainous District Use)

①산림청장등은 제14조에 따른 산지전용허가 또는 제15조의2제1항에 따른 산지일시사용허가를 받거나 제15조에 따른 산지전용신고 또는 제15조의2제4항에 따른 산지일시사용신고를 한 자가 다음 각 호의 어느 하나에 해당하는 경우에는 농림축산식품부령으로 정하는 바에 따라 허가를 취소하거나 목적사업의 중지, 시설물의 철거, 산지로의 복구, 그 밖에 필요한 조치를 명할 수 있다. 다만, 제1호에 해당하는 경우에는 그 허가를 취소하거나 목적사업의 중지 등을 명하여야 한다. <개정 2012.2.22, 2013.3.23, 2019.12.3, 2020.2.18, 2021.6.15>

1. 거짓이나 그 밖의 부정한 방법으로 허가를 받거나 신고를 한 경우

3. 제19조에 따른 대체산림자원조성비를 내지 아니하였거나 제38조에 따른 복구비를 예치하지 아니한 경우(제37조제9항에 따른 줄어든 복구비 예치금을 다시 예치하지 아니한 경우를 포함한다)

4. 제37조제7항 각 호의 어느 하나에 해당하는 필요한 조치 명령에 따른 재해 방지 또는 복구를 위한 명령을 이행하지 아니한 경우

6. 허가를 받은 자가 허가취소를 요청하거나 신고를 한 자가 신고를 철회하는 경우

② 산림청장등은 다른 법률에 따라 산지전용허가ㆍ산지일시사용허가 또는 산지전용신고ㆍ산지일시사용신고가 의제되는 행정처분을 받은 자가 제1항 각 호의 어느 하나에 해당하는 경우에는 산지전용 또는 산지일시사용의 중지를 명할 수 있다. <신설 2012.2.22>

③ 산림청장등은 제2항에도 불구하고 다른 법률에 따라 산지전용허가ㆍ산지일시사용허가 또는 산지전용신고ㆍ산지일시사용신고가 의제되는 행정처분을 받은 자가 제1항제3호에 해당하는 경우에는 관계 행정기관의 장에게 그 목적사업에 관련된 승인ㆍ허가 등의 취소를 요청할 수 있다. <신설 2018.3.20>
