산지관리법 제43조(복구비의 반환)

Mountainous Districts Management Act, Article 43 (Return of Restoration Costs)

① 산림청장등은 다음 각 호의 어느 하나에 해당할 때에는 복구면적을 기준으로 예치된 복구비의 전부 또는 일부를 그 예치자에게 반환하여야 한다. <개정 2012.2.22>

1. 제39조제3항에 따른 복구의무면제가 확정되었을 때

2. 제42조에 따른 복구준공검사가 완료되었을 때

3. 제44조제1항에 따른 시설물 철거 명령이나 산지복구의 명령(같은 항 제3호부터 제5호까지의 경우만 해당한다)을 이행하거나 같은 조 제2항에 따른 대집행이 완료되었을 때

4. 산지전용허가 등의 처분을 받은 자가 목적사업을 시작하지 아니한 채 산지전용허가 등의 효력이 소멸되었을 때

② 산림청장등은 제1항에 따라 예치된 복구비를 반환할 때 제41조제1호 또는 제44조제2항 후단에 따라 대행 비용이나 대집행 비용을 예치된 복구비에서 충당한 경우에는 그 충당한 비용을 공제한 후 반환하여야 한다. <개정 2012.2.22>
