산지관리법 제42조(복구준공검사)

① 산림청장등은 복구의무자가 복구를 완료하거나 제41조에 따른 대행 또는 대집행에 의하여 복구가 완료되면 복구준공검사를 하여야 한다. <개정 2012.2.22>

② 산림청장등은 제1항에 따른 복구준공검사를 받으려는 자로 하여금 복구준공검사 후에 발생하는 하자를 보수하도록 하기 위하여 농림축산식품부령으로 정하는 바에 따라 하자보수보증금을 미리 예치하게 하여야 한다. 다만, 제38조제1항 단서에 따라 복구비를 예치하지 아니하는 경우와 그 밖에 대통령령으로 정하는 경우에는 하자보수보증금의 예치를 면제할 수 있다. <개정 2012.2.22, 2013.3.23>

③ 제1항에 따른 복구준공검사의 신청절차 등과 제2항에 따른 하자보수보증금의 금액, 예치방법, 예치기간 등에 관한 사항은 농림축산식품부령으로 한다. <개정 2013.3.23>
