빈집 및 소규모주택 정비에 관한 특례법 제28조의2(소규모재개발사업의 분양받을 권리의 산정 기준일)

① 소규모재개발사업을 통하여 분양받을 건축물이 다음 각 호의 어느 하나에 해당하는 경우에는 제18조제2항, 제19조제2항, 제22조제10항 또는 제23조제9항에 따른 고시가 있은 날 또는 시장ㆍ군수등이 투기를 억제하기 위하여 사업시행자의 지정, 주민합의체의 구성 또는 조합설립인가 고시 전에 따로 정하는 날(이하 이 조에서 "기준일"이라 한다)의 다음 날을 기준으로 건축물을 분양받을 권리를 산정한다. <개정 2023.4.18>

② 시장ㆍ군수등은 제1항에 따라 기준일을 따로 정하는 경우에는 기준일, 지정사유, 건축물을 분양받을 권리의 산정기준 등을 해당 지방자치단체의 공보에 고시하여야 한다.
