부동산투자회사법 제39조의2(금융위원회의 감독)

① 금융위원회는 공익을 위하여 또는 부동산투자회사의 주주를 보호하기 위하여 필요하면 부동산투자회사등에 금융감독 관련 업무에 관한 자료 제출이나 보고를 명할 수 있으며, 금융감독원의 원장으로 하여금 그 업무에 관하여 검사하게 할 수 있다.

② 금융위원회는 부동산투자회사등이 이 법 또는 이 법에 따른 명령이나 처분을 위반하거나, 제49조의3제1항에 따른 공모부동산투자회사 또는 자산관리회사(공모부동산투자회사가 아닌 부동산투자회사로부터만 자산의 투자ㆍ운용을 위탁받은 자산관리회사는 제외한다)가 「자본시장과 금융투자업에 관한 법률」 또는 같은 법에 따른 명령이나 처분을 위반한 경우 또는 「금융소비자 보호에 관한 법률」 제17조부터 제22조(제6항은 제외한다)까지 및 제23조를 위반한 경우에는 제39조제2항 각 호의 어느 하나에 해당하는 조치를 하도록 국토교통부장관에게 요구할 수 있고, 국토교통부장관은 특별한 사유가 없으면 요구에 따라야 한다. 이 경우 국토교통부장관은 그 조치 내용을 금융위원회에 통보하여야 한다. <개정 2013.3.23, 2020.3.24>
