Act on the Improvement of Urban Areas and Residential Environments, Article 78 (Public Inspection of, and Approval Procedures for, Management and Disposal Plans)

① 사업시행자는 제74조에 따른 관리처분계획인가를 신청하기 전에 관계 서류의 사본을 30일 이상 토지등소유자에게 공람하게 하고 의견을 들어야 한다. 다만, 제74조제1항 각 호 외의 부분 단서에 따라 대통령령으로 정하는 경미한 사항을 변경하려는 경우에는 토지등소유자의 공람 및 의견청취 절차를 거치지 아니할 수 있다.

② 시장ㆍ군수등은 사업시행자의 관리처분계획인가의 신청이 있은 날부터 30일 이내에 인가 여부를 결정하여 사업시행자에게 통보하여야 한다. 다만, 시장ㆍ군수등은 제3항에 따라 관리처분계획의 타당성 검증을 요청하는 경우에는 관리처분계획인가의 신청을 받은 날부터 60일 이내에 인가 여부를 결정하여 사업시행자에게 통지하여야 한다. <개정 2017.8.9>

③ 시장ㆍ군수등은 다음 각 호의 어느 하나에 해당하는 경우에는 대통령령으로 정하는 공공기관에 관리처분계획의 타당성 검증을 요청하여야 한다. 이 경우 시장ㆍ군수등은 타당성 검증 비용을 사업시행자에게 부담하게 할 수 있다. <신설 2017.8.9>

⑤ 사업시행자는 제1항에 따라 공람을 실시하려거나 제4항에 따른 시장ㆍ군수등의 고시가 있은 때에는 대통령령으로 정하는 방법과 절차에 따라 토지등소유자에게는 공람계획을 통지하고, 분양신청을 한 자에게는 관리처분계획인가의 내용 등을 통지하여야 한다. <개정 2017.8.9>

⑦ 사업시행자는 관리처분계획의 내용이 제3항제1호 또는 제2호에 해당하는 경우 관리처분계획인가의 신청 이전(제45조제1항제10호에 따른 총회 의결이 있은 경우로 한정한다)에 제3항에 따른 공공기관에 관리처분계획의 타당성 검증을 요청할 수 있다. 이 경우 제3항에 따른 타당성 검증이 요청된 것으로 본다. <신설 2025.1.31>
