농어촌마을 주거환경 개선 및 리모델링 촉진을 위한 특별법 제32조(정비사업의 준공인가)

① 시장ㆍ군수ㆍ구청장이 아닌 사업시행자는 정비사업에 관한 공사를 완료한 때에는 대통령령으로 정하는 방법 및 절차에 따라 시장ㆍ군수ㆍ구청장의 준공인가를 받아야 한다.

② 제1항에 따라 준공인가신청을 받은 시장ㆍ군수ㆍ구청장은 지체 없이 준공검사를 실시하여야 한다. 이 경우 시장ㆍ군수ㆍ구청장은 효율적인 준공검사를 위하여 필요한 때에는 관계 행정기관, 전문기관 또는 단체에 준공검사의 실시를 의뢰할 수 있다.

③ 사업시행자가 제1항에 따른 준공인가를 받았을 때에는 제17조에서 규정하는 인ㆍ허가등에 따른 해당 사업의 준공에 대한 검사ㆍ인가ㆍ신고ㆍ확인 등을 받은 것으로 본다. 이 경우 시장ㆍ군수ㆍ구청장은 그 사항에 관하여 관계 행정기관의 장과 미리 협의하여야 한다.

④ 시장ㆍ군수ㆍ구청장은 제2항에 따른 준공검사의 실시결과 정비사업이 승인받은 실시계획대로 완료되었다고 인정하는 때에는 준공인가를 하고 공사의 완료를 해당 지방자치단체의 공보에 고시하여야 한다.

⑤ 시장ㆍ군수ㆍ구청장은 직접 시행하는 정비사업에 관한 공사가 완료된 때에는 그 공사의 완료를 해당 지방자치단체의 공보에 고시하여야 한다.

⑥ 시장ㆍ군수ㆍ구청장은 제1항에 따른 준공인가를 하기 전이라도 완공된 건축물이 사용에 지장이 없는 등 대통령령으로 정하는 기준에 적합한 경우에는 입주예정자가 완공된 건축물을 사용할 것을 사업시행자에 대하여 허가할 수 있다.

⑦ 제4항 및 제5항에 따른 공사완료의 고시 절차 및 방법, 그 밖에 필요한 사항은 대통령령으로 정한다.
