공직자 등의 병역사항 신고 및 공개에 관한 법률 시행령 제16조(당선인 등의 병역사항 통보 등)

① 법 제9조제4항 또는 법 제10조제3항에 따라 관할 선거구선거관리위원회 위원장이나 국회의장이 당선인 또는 「인사청문회법」 제2조제2호에 따른 임명동의안등이 처리된 사람(이하 "당선인등"이라 한다)의 병역사항을 통보하는 때에는 병역사항 신고의무자 명부에 병역사항 신고서 및 신고대상자의 병적증명서(복무 중인 사람의 경우에는 복무확인서를 말한다)를 첨부하여야 한다. 이 경우 관할 선거구선거관리위원회 위원장이나 국회의장은 병역사항 신고서 및 병적증명서의 사본 각 1부를 당선인등의 소속 신고기관의 장에게 보내야 한다. <개정 2019.10.29>

② 법 제9조제4항 및 법 제10조제3항에 따라 병무청장이나 지방병무청장에게 통보된 당선인등에 관하여는 제11조부터 제14조까지를 준용한다.
