공직자 등의 병역사항 신고 및 공개에 관한 법률 제9조(공직선거후보자의 병역사항 신고 및 공개)

① 「공직선거법」 제2조에 따른 선거의 후보자가 되려는 자(비례대표의원의 경우는 추천 정당을 말한다. 이하 "공직선거후보자"라 한다)는 그 선거의 후보자 등록을 하려면 등록일 전 1개월 현재의 제3조에 따른 병역사항을 서면으로 관할 선거구 선거관리위원회에 신고하여야 한다.

② 공직선거후보자가 제1항에 따른 병역사항을 신고할 때에는 지방병무청장이 발급한 신고대상자의 병적증명서(복무 중인 사람은 복무부대장이나 복무기관의 장이 발행한 복무확인서를 말한다)를 첨부하여야 한다.

③ 관할 선거구 선거관리위원회가 후보자 등록을 공고할 때에는 제1항에 따라 신고받은 병역사항을 공개하여야 한다. 이 경우 제8조제3항을 준용한다. <개정 2010.3.17, 2017.11.28>

④ 관할 선거구 선거관리위원회위원장은 당선인이 확정되면 1개월 이내에 그 병역사항(비례대표의원의 의석을 승계한 당선인의 경우에는 신고일 이후에 변동된 병역사항을 말한다)을 대통령령으로 정하는 바에 따라 병무청장이나 지방병무청장에게 통보하여야 한다.

⑤ 관할 선거구 선거관리위원회위원장이 제4항에 따라 병역사항을 통보하면 신고의무자가 제4조에 따른 신고의무를 이행한 것으로 본다.

(5) When웬 the^ð더 chair체어 of어^v브 the^ð디 election일렉션 commission커미션 of어^v브 the^ð더 competent캄퍼틴트 election일렉션 district디스트^r릭트 notifies노우터^f파이즈 military밀러테^r리 service서^v비스 information인^f퍼메이션 under언더 paragraph패^r러그^r래^f프 (4), the^ð더 person퍼슨 obligated아블러게이티드 to투 report^r리포트 is이즈 deemed딤드 to투 have해^v브 performed퍼^f폼드 the^ð더 reporting^r리포팅 obligation아블러게이션 under언더 Article아터클 4.

⑥ 신고서 서식, 공개방법, 그 밖에 필요한 사항은 중앙선거관리위원회 규칙으로 정한다.
