Act on Prohibition of Fraudulent Claims on Public Finance and Recovery of Illicit Gains, Article 23 (Awards and Compensation for Reporters, etc.)

① 위원회는 제17조에 따른 신고로 공공기관에 현저한 재산상 이익을 얻게 하거나 손실을 방지한 경우 또는 공익을 증진한 경우에는 신고를 한 사람에게 「부패방지 및 국민권익위원회의 설치와 운영에 관한 법률」 제69조에 따른 보상심의위원회(이하 "보상심의위원회"라 한다)의 심의ㆍ의결을 거쳐 포상금을 지급하거나 「상훈법」 등의 규정에 따라 포상을 추천할 수 있다.

② 제17조에 따라 신고한 사람은 해당 신고로 인하여 다음 각 호의 어느 하나에 해당하는 조치를 통하여 공공기관의 직접적인 수입의 회복ㆍ증대 또는 비용의 절감에 기여한 경우에는 위원회에 보상금(補償金)의 지급을 신청할 수 있다. <개정 2024.3.26>

④ 위원회는 제1항에 따른 포상금 지급 또는 제2항에 따른 보상금 지급을 위하여 필요한 경우(「부패방지 및 국민권익위원회의 설치와 운영에 관한 법률」 제29조제2항 각 호의 어느 하나에 해당하는 경우는 제외한다)에는 다음 각 호의 조치를 할 수 있다.

⑤ 제3항에 따른 구조금 지급과 관련한 조사ㆍ조회, 구조금의 지급 범위 및 손해배상청구권의 대위에 관하여는 「공익신고자 보호법」 제27조제3항부터 제5항까지를 준용한다. 이 경우 "공익신고자등"은 "신고자등"으로 본다. <신설 2024.3.26>
