Enforcement Decree of the Trucking Transport Business Act, Article 15-2 (Processing of Sensitive Information and Personally Identifiable Information)
①국토교통부장관, 시ㆍ도지사, 시장 또는 군수(법 제47조의2제4항, 제63조 및 제64조에 따라 그 권한을 위임ㆍ재위임 또는 위탁받는 자를 포함하며, 제10호의2 및 제10호의3의 경우 군수는 광역시의 군수를 포함한다) 및 「보험업법」에 따른 보험회사(적재물배상책임 공제사업을 하는 자를 포함한다)는 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법 시행령」 제18조제2호에 따른 범죄경력자료에 해당하는 정보나 같은 영 제19조에 따른 주민등록번호, 운전면허의 면허번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2013.3.23, 2013.6.11, 2014.11.28, 2015.12.22, 2017.3.27, 2019.6.25, 2020.6.16, 2025.10.28>
(1) The Minister of Land, Infrastructure and Transport, a Mayor/Do Governor, a Mayor, or the head of a Gun (including a person to whom the authority is delegated, redelegated, or entrusted under Articles 47-2 (4), 63, and 64 of the Act; in the case of subparagraphs 10-2 and 10-3, the head of a Gun includes the head of a Gun in a Metropolitan City) and an insurance company under the Insurance Business Act (including a person who operates a cargo liability mutual aid business) may, where inevitable for performing any of the following affairs, process data containing information constituting criminal record data under Article 18, subparagraph 2 of the Enforcement Decree of the Personal Information Protection Act or resident registration numbers, driver's license numbers, or alien registration numbers under Article 19 of that Decree:

3. Affairs concerning recording and managing the traffic safety records of truck drivers under Article 10-2 of the Act;
4. 법 제16조에 따른 화물자동차 운송사업의 양도와 양수 등에 관한 사무
4. Affairs concerning transfer and acquisition, etc. of the truck freight transport business under Article 16 of the Act;
5. 법 제17조에 따른 화물자동차 운송사업의 상속에 관한 사무
5. Affairs concerning succession to the truck freight transport business under Article 17 of the Act;
6. 법 제19조에 따른 화물자동차 운송사업의 허가 취소 등에 관한 사무
6. Affairs concerning revocation of permission, etc. for the truck freight transport business under Article 19 of the Act;
7. 법 제23조에 따른 화물운송 종사자격의 취소 등에 관한 사무
7. Affairs concerning revocation, etc. of the qualification for engaging in freight transport under Article 23 of the Act;
7의2. 법 제24조에 따른 화물자동차 운송주선사업의 허가 등에 관한 사무
7-2. Affairs concerning permission, etc. for the truck freight forwarding business under Article 24 of the Act;
8. 법 제27조에 따른 화물자동차 운송주선사업의 허가취소 등에 관한 사무
8. Affairs concerning revocation of permission, etc. for the truck freight forwarding business under Article 27 of the Act;
8의2. 법 제29조에 따른 화물자동차 운송가맹사업의 허가 등에 관한 사무
8-2. Affairs concerning permission, etc. for the truck transport franchise business under Article 29 of the Act;
9. 법 제32조에 따른 화물자동차 운송가맹사업의 허가취소 등에 관한 사무
9. Affairs concerning revocation of permission, etc. for the truck transport franchise business under Article 32 of the Act;
10. 법 제38조에 따른 책임보험계약등의 계약 종료일 통지 등에 관한 사무
10. Affairs concerning notification of the termination date, etc. of liability insurance contracts, etc. under Article 38 of the Act;
10의2. 법 제43조제2항에 따른 보조금의 지급에 관한 사무

13-2. Affairs concerning permission for paid transport by private trucks under the proviso of Article 56 of the Act;
14. 법 제59조에 따른 운수종사자의 교육 등에 관한 사무
14. Affairs concerning education, etc. of transport workers under Article 59 of the Act.
② 연합회 또는 법 제51조의2에 따른 공제조합은 법 제51조 또는 제51조의6에 따른 공제사업을 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보나 같은 법 시행령 제19조 각 호에 따른 주민등록번호, 여권번호, 운전면허의 면허번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <신설 2014.11.28>
(2) A federation or a mutual aid association under Article 51-2 of the Act may, where inevitable for performing the mutual aid business under Article 51 or 51-6 of the Act, process data containing information on health under Article 23 of the Personal Information Protection Act or resident registration numbers, passport numbers, driver's license numbers, or alien registration numbers under the subparagraphs of Article 19 of the Enforcement Decree of that Act.
