화물자동차 운수사업법 제17조(화물자동차 운송사업의 상속)

① 운송사업자가 사망한 경우 상속인이 그 화물자동차 운송사업을 계속하려면 피상속인이 사망한 후 90일 이내에 국토교통부장관에게 신고하여야 한다. <개정 2013.3.23, 2013.7.16>

② 국토교통부장관은 제1항에 따른 신고를 받은 날부터 5일 이내에 신고수리 여부를 신고인에게 통지하여야 한다. <신설 2017.3.21>

③ 국토교통부장관이 제2항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장 여부를 신고인에게 통지하지 아니하면 그 기간이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2017.3.21>

④ 상속인이 제1항의 신고를 하면 피상속인이 사망한 날부터 신고한 날까지 피상속인에 대한 화물자동차 운송사업의 허가는 상속인에 대한 허가로 본다. <개정 2017.3.21>

⑤ 제1항에 따라 신고한 상속인은 피상속인의 운송사업자로서의 지위를 승계한다. <개정 2017.3.21>

⑥ 제1항의 상속인의 결격사유에 관하여는 제4조를 준용한다. 다만, 상속인이 피상속인의 사망일부터 3개월 이내에 그 화물자동차 운송사업을 다른 사람에게 양도하면 피상속인의 사망일부터 양도일까지 피상속인에 대한 화물자동차 운송사업의 허가는 상속인에 대한 허가로 본다. <개정 2017.3.21>
