학교보건법 제14조(질병의 예방)

① 학교의 장은 감염병 예방과 학교의 보건에 필요하면 휴업을 할 수 있다.

② 관할청은 감염병 예방과 학교의 보건에 필요하면 해당 학교에 대하여 다음 각 호의 어느 하나에 해당하는 조치를 명할 수 있다. 다만, 교육부장관은 제2조제3호가목의 학교의 경우에는 그 권한을 교육감에게 위임할 수 있다.

③ 제1항 및 제2항에도 불구하고 감염병으로 인하여 「재난 및 안전관리 기본법」 제38조제2항에 따른 주의 이상의 위기경보가 발령되어 제1항 또는 제2항에 따른 조치를 하는 경우 학교의 장은 관할청의 동의를, 교육감은 교육부장관의 동의를 받아야 한다.
